Abstract

Semenjak dikeluarkannya Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 terjadi ketidakpastian hukum, dampak tersebut terutama dialami oleh Notaris, di mana putusan tersebut hanya membahas mengenai kemanusiaan seorang anak luar kawin namun tidak membahas mengenai perhitungan waris yang tentunya akan berpengaruh pada status atau kedudukan anak luar kawin sebagai ahli waris. Selain itu juga timbul pertanyaan apakah putusan MK tersebut dapat berlaku surut bagi anak-anak luar kawin yang lahir sebelum putusan tersebut ada. Penulis menggunakan metode penelitian hukum normatif dengan pendekatan undang-undang, pendekatan kasus, dan pendekatan konseptual. Dari hasil penelitian tersebut dapat disimpulan bahwa putusan MK tersebut tidak membahas mengenai pewarisan dan putusan MK tidak dapat diberlakukan surut atau harus bersifat prospektif atau berlaku ke depan agar tercipta keadilan /Since the issuance of the Constitutional Court Decision No. 46 / PUU-VIII / 2010 there was legal uncertainty, the impact is mainly experienced by a Notary, in which the decision is only discussed the human child is outside marry but does not discuss the calculation of inheritance which will certainly affect the status or position beyond mating child as the beneficiary. It also raised the question whether the decision of the Court may be retroactive to children born outside of mating before the decision there. The author uses the method of normative legal research with law approach, case approach, and a conceptual approach. From the results of these studies can be concluded that the decision of the Court did not discuss the decision of the Court of inheritance and can not be applied retroactively or prospectively or valid should be forward in order to create justice
