Abstract

Tujuan pendaftaran tanah antara lain adalah untuk memberikan kepastian hukum atas status hak atas tanah yang terdaftar. Dalam rangka melaksanakan program Landreform, Peraturan Menteri Agraria Nomor 3 tahun 1997 tentang Ketentuan Pelaksanaan dari Peraturan Pemerintah Nomor 24 tahun 1997 tentang Pendaftaran Tanah mengatur kewajiban untuk menerbitkan instrumen hukum Surat Pernyataan sebelum dilaksanakannya penandatangan Akta Jual Beli. Di dalam pelaksanaannya Surat Pernyataan tersebut digunakan juga untuk tanah hak non pertanian, sehingga untuk mengetahui apakah implementasi dari penerbitan instrumen hukum tersebut cukup memberikan jaminan kepastian hukum, diperlukan penelitian hukum mengenai eksistensi Surat Pernyataan Tidak Dimilikinya Tanah Absentee di dalam proses pendaftran tanah. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan dan juga pendekatan historis. Dari hasil penelitian tersebut dapat disimpulkan bahwa Surat Pernyataan Tidak Dimilikinya Tanah Absentee belum dapat sepenuhnya menjamin kepastian hukum sebagaimana diamanatkan oleh undang-undang, khususnya bagi pembeli tanah hak non pertanian dalam proses pendaftaran peralihan tanah karena jual beli. / The purpose of land registration among others is to give a legal certainty to the registered land status. In line with the implementation of landreform program, Minister of Agrarian/Head of National Land Institution Regulation number 3 year 1997 regarding the implementing provisions of Governement Regulation number 24 year 1997 regarding Land Registration, regulate an obligation to the land buyer to sign a legal instrument so called Statement Letter, before signing the sell and purchase deed. In its implementation, the Statement Letter had been used as well for the interest of non farm ownership, so that to evaluate wether the implementation of the said landreform legal instrument has provided sufficiently legal certainty, it is necessary to conduct a legal research in connection with the existence of the Statement Letter Regarding Prohibition To Posses Absentee Land in the land registration process. In this research, data collection is served by using the statute approach and historical approach and it can be concluded that the Statement Letter Regarding Prohibition To Posses Absentee Land is not appropriate and sufficient to provide legal certainty as mandated by the laws, especially for a non farm ownership buyer in the land transition registration process due to the sell and purchase
