Abstract

Perjanjian Pengikatan Jual Beli merupakan perjanjian permulaan (pactum de contrahendo) dari Perjanjian Jual Beli yang memiliki persamaan dalam persyaratannya. Persamaan syarat ini dapat dilihat dari subyeknya yang diatur dalam Pasal 1457 KUHPerdata, yaitu adanya pembeli yang menyerahkan suatu kebendaan dan penjual yang membayar harga yang telah dijanjikan, barang dan harga sebagai unsur esensialia. Yang membedakan dalam perjanjian pengikatan jual beli adalah adanya syarat-syarat yang apabila belum terpenuhi maka jual beli belum dapat dilaksanakan. Dalam perjanjian tersebut dimuat janji-janji dari para pihak yang mengandung ketentuan-ketentuan yang mana syarat untuk jual beli yang sebenarnya terpenuhi. Dalam penelitian ini dibahas tentang kekuatan hukum Akta Pengikatan Jual Beli yang dibuat dihadapan Notaris dan perlindungan hukum Pembeli yang dinyatakan wanprestasi. Dalam prakteknya, sebelum dilakukan jual beli dihadapan Pejabat Pembuat Akta Tanah (PPAT) yang berwenang, para pihak melakukan suatu perbuatan hukum dengan cara membuat akta pengikatan jual beli dihadapan Notaris, dengan memenuhi segala ketentuan yang diatur dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata). Penelitian ini bersifat yuridis normatif dengan metode pendekatan terhadap Undang-undang dan kasus yang sudah memiliki kekuatan hukum tetap dan Pengolahan bahan hukum dalam penelitian hukum yuridis normatif adalah metode penelitian yang dilakukan dengan meneliti bahan pustaka atau data sekunder. Penelitian ini dilakukan untuk mengidentifikasikan Putusan Pengadilan Negeri Jakarta Selatan Nomor: 632/Pdt.G/2012/PN.Jkt.Sel tanggal 20 September 2013 atas gugatan wanprestasi yang dilakukan oleh Para Ahli Waris Penjual. Dari hasil penelitian disimpulkan, akta yang dibuat adalah merupakan akta otentik yang memiliki kekuatan hukum dengan jaminan kepastian hukum sebagai alat bukti tulisan yang sempurna, tidak memerlukan tambahan alat pembuktian lain, dan hakim terikat karenanya. Perlindungan hukum diberikan oleh negara kepada pihak yang memiliki itikad baik. Dalam penelitian ini Pembeli sebagai yang beritikad baik meminta perlindungan dari negara agar atas akta yang dibuatnya sah dan berharga / The preliminary Sale and Purchase Agreement is the preliminary Agreement (pactum de contrahendo) of the Sale and Purchase Agreement which have similarities in the terms. The similarity of terms can be seen in the subjects dealt with in Article 1457 of the Civil Code, that is the buyer who submit a goods and the seller who pay the price that has been promised, the goods and price are the binding elements. What distinguishes in the preliminary sale and purchase agreement is the existence of the conditions which, if not met, the purchase cannot be implemented. In the agreement contained promises of the parties containing provisions as the terms for the real sale and purchase to be fulfilled. In this research will be discussed on the legal strength of the Preliminary Sale and Purchase Agreement Deed which is made before a Notary and the legal protection of the buyer declared in default. In practice, prior to the sale and purchase agreement deed is made before the authorized Conveyancer (PPAT), the parties shall commit the legal act by way of entering into the Preliminary Sale and Purchase Agreement deed made before the Notary, by fulfilling all the conditions stipulated in the Civil Code. This study is juridical normative approach to legislation, and the cases that have permanent legal force, and the legal materials processing in normative legal research are the method of researches which have been done by researching the library materials or secondary data. This study has been conducted to identify the South Jakarta District Court Verdict No. 632/Pdt.G/2012/PN.Jkt.Sel dated 20 September 2013 on the lawsuit for breach of contract committed by the Seller’s heirs. From the researches can be concluded that the deed made is an authentic deed which has the force of law to guarantee the legal certainty as the perfect writing evidence, does not require other additional evidences, and the judge is bound by it. The legal protection is granted by the State to those who have good faith. Buyer in this study as a good faith asking for protection from the State so that the deed made is valid and valuable.
