Abstract

Perkawinan merupakan dasar terwujudnya pertalian keluarga, sehingga dengan adanya ikatan perkawinan ini akan menyebabkan adanya akibat-akibat dalam perkawinan antara suami istri tersebut sehingga akan mempengaruhi pula terhadap hubungan keluarga dari yang bersangkutan. Perkawinan termasuk hukum keluarga. Hukum keluarga adalah keseluruhan norma-norma hukum, tertulis maupun tidak tertulis, yang mengatur hubungan kekeluargaan, baik yang diakibatkan oleh hubungan darah maupun perbuatan hukum tertentu. Perbuatan hukum yang dimakasud seperti perkawinan, pengangkatan anak, dan lain-lain. Hubungan kekeluargaan antara lain berisi kewajiban dan hak dalam kehidupan berkeluarga, seperti kewajiban dan hak anak terhadap orang tua atau sebaliknya. Adapun permasalahan dalam penulisan tesis ini adalah Bagaimana hukum adat Bali mengatur mengenai hak waris anak hasil perkawinan poligami. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan membandingkan peraturan perundang-undangan yang berlaku di bidang perkawinan bagi masyarakat Hindu dan Putusan Pengadilan menyangkut pembagian harta warisan. Proses pengaturan perkawinannya menggunakan Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan dan Hukum Adat Bali serta Hukum Masyarakat Hindu. Norma-norma hukum tidak tertulis dalam peraturan aturan perundang- undangan yang mengatur hubungan kekeluargaan disebut hukum adat keluarga. Eksistensi hukum adat keluarga dalam masyarakat adat Bali, masih sangat kuat. Artinya masih diakui dan diikuti oleh masyarakat adat Bali, di luar yang telah diatur oleh Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan. Agak sulit memahami keberadaan hukum keluarga bagi masyarakat adat Bali atau umat Hindu di Bali, tanpa memahami sistem kekeluargaan bagi umat Hindu di Bali. Demikian pula halnya kalau ingin memahami perkawinan tata cara pelaksanaan dan bentuk perkawinannya. Dengan demikian norma hukumnya adalah penerapan Undang-Undang Perkawinan Nasional dan Perkawinan Masyarakat Hindu serta Hukum Adat Bali sebagai pelaksanaannya terhadap perkawinan poligami pun demikian / This Thesis dicusses about Marriage is the basis for the establishment of family ties, so with this marital bond would cause repercussions in the marriage between husband and wife so it will affect also the relationship of the family concerned. A marriage is included in family law. Family Law is the overall norms of the law, written or unwritten, that govern family relationships whether caused by birth or by certain legal actions. Legal act that is referred to as marriage, adoptions, etc. Family relationships is contain the obligations and rights in family life, such as the duties and rights of children to their parents or vice versa. As for the problems in this thesis is how the Balinese customary law governing the inheritance rights of the child of a polygamous marriages. the method used in this research is normative juridical by comparing the legislation in force in the field of marriage for Hindu society and judicial decisions concerning the division of the inheritance.The process of setting the marriage using The Constitution of state laws number 1 in 1974 and customary law and legal Bali Hindu society. Norms of unwritten law in the legislation governing family relationships is called customary law family. existence of customary law in indigenous communities bali family is still very strong. Which means, it is still recognized and acknowledged by the indigenous people of Bali, beyond what has been regulated by The Constitution of state laws number 1 in 1974 about marriage. rather difficult to understand the existence of family law for indigenous peoples bali or Hindus in Bali. as well as if you want to understand the procedures of marriage and its forms.Therefore, the legal norm is the application of national law marriage and marriage of Hindu society as well as customary law Bali as their implementation of polygamous marriages also
