Abstract

In the writing of this thesis will be examined about the accountability of a notary publicly associated with the loss of Minuta Deed resulting negligence based on the law position of Notary. This is the background because the Notary in carrying out his position as public officer has an obligation to save the deed Minutes as part of Notary protocol as set out in the law position of Notary. But on the way there is often a loss of minuta deed. From the background, then the problem arises, How is the responsibility of a Notary related to the loss of minuta deeds resulting from his negligence and How does Notary effort replace the lost minuta deed? In this research, the author use literature research methods and using the approach of legislation. The result of the research is concluded that the responsibility of Notary is related to the loss of minuta deed due to negligence based on the law position of Notary, may be subject to sanctions in accordance with Article 16 paragraph (11) the law position of Notary, whereas Code of Conduct, the notary is subject to sanction according to Article 6 paragraph (1). civil liability for the negligence of omitting the deed minus, pursuant to Articles 1365 and 1366 of the Civil Code, if any party feels aggrieved over the loss of the deed Minutes, then the Notary is obliged to provide compensation. Notary's effort to replace the lost ministry, if a copy has not been made, the Notary must call the parties then remade and re-signed by the parties, but if a copy has been made then the Notary concerned shall make the report of loss to the police and the official report to the Regional Supervisory Council. Alternatively, by making an official report signed by the witnesses, witnesses and notaries, where the parties and witnesses state that on the day, date and time according to the copy of the deed is dated and the number, there has been a signing of the deed. Further the parties and witnesses state and affirm that the contents of the agreement are in accordance with the copy of the deed, number and date as attached and initialed on each page. / Pada penulisan tesis ini akan dibahas tentang Pertanggungjawaban Notaris Dikaitkan dengan Hilangnya Minuta Akta Yang Diakibatkan Kelalaian Berdasarkan Undang-undang Jabatan Notaris. Hal ini dilatarbelakangi karena Notaris dalam menjalankan jabatannya selaku Pejabat Umum mempunyai kewajiban untuk menyimpan minuta akta sebagai bagian dari protokol notaris sebagaimana diatur dalam Undang-Undang Jabatan Notaris. Namun dalam perjalanannya sering terjadi adanya kehilangan minuta akta. Dari latar belakang tersebut maka muncul permasalahan, Bagaimana tanggung jawab notaris terkait hilangnya minuta akta yang diakibatkan kelalaiannya serta Bagaimana upaya notaris menggantikan minuta akta yang hilang? Dalam penelitian ini, penulis menggunakan metode penelitian kepustakaan, dan menggunakan pendekatan perundang-undangan. Dari hasil penelitian, disimpulkan bahwa pertanggungjawaban Notaris dikaitkan dengan hilangnya minuta akta akibat kelalaiannya berdasarkan Undang-Undang Jabatan Notaris dapat dikenakan sanksi sesuai dengan Pasal 16 ayat (11) Undang-Undang Jabatan Notaris, sedangkan secara Kode Etik, Notaris tersebut dikenakan sanksi sesuai Pasal 6 ayat 1. Secara perdata atas kelalaiannya menghilangkan minuta akta, berdasarkan Pasal 1365 dan 1366 KUHPerdata, apabila ada pihak yang merasa dirugikan atas hilangnya minuta akta, maka Notaris tersebut wajib memberikan ganti rugi. Upaya Notaris menggantikan minuta yang hilang, jika salinan belum dibuat maka Notaris wajib memanggil para pihak selanjutnya dibuat minuta ulang dan ditandatangani ulang para pihak, namun jika telah dibuatkan salinan maka Notaris yang bersangkutan harus membuat berita acara kehilangan ke kepolisian dan berita acara ke Majelis Pengawas Daerah. Alternatif lainnya dengan membuat berita acara yang ditandatangani oleh para penghadap, saksi dan Notaris, dimana para pihak dan saksi menyatakan bahwa pada hari, tanggal dan pukul sesuai dengan salinan akta tertanggal dan nomor tersebut, benar telah terjadi penandatanganan akta. Selanjutnya para pihak dan saksi menyatakan dan menegaskan bahwa isi kesepakatan adalah sesuai dengan salinan akta, nomor dan tanggal tersebut sebagaimana terlampir dan diparaf pada setiap halaman.
