Abstract

The Official Certifier of Title Deeds (PPAT) is a authorized public official which have discretion to make an authentic deed for transfer of Rights on Land and Buildings including the Ownership Right of Strata Title with the status of Rights to Build over the Right to Manage and therefore the PPAT is required to comply with all laws and regulations to undertake its position. The issues in this thesis is the role of PPAT on sale and purchase transaction of Strata Title with the status of the Right to Build over the Right to Manage and the opinion of the Civil Judge on the action of PPAT in the sale and purchase transaction of Strata Title with the status of Rights to Build over the Right to Manage. The research method in this thesis is normative juridical, hence the author analyze the role of PPAT in the management of ownership rights of Strata Title with the status of Rights to Build over the Right to Manage. The results of the author’s research are the PPAT roles in the sale and purchase transaction of Strata Title with the status of the Right to Build over the Right to Manage is still need to check the physical and juridical data and still have to obtain approval from the Right of Manage holders in this case is The Regional Government of DKI (PEMDA DKI) and there is errors in the resolution of the Civil Judge at the appeal and cassation level on the role of PPAT in the sale and purchase transaction of Strata Title with the status of Rights to Build over the Right to Manage. / Pejabat Pembuat Akta Tanah (PPAT) adalah pejabat umum yang diberikan kewenangan untuk membuat akta otentik untuk mengalihan hak atas tanah dan bangunan termasuk mengenai hak kepemilikan atas satuan rumah susun berstatus hak guna bangunan di atas hak pengelolaan dan dengan demikian PPAT tersebut wajib mematuhi semua peraturan dan perundang-undangan dalam menjalankan jabatannya. Rumusan masalah dalam penulisan ini adalah peran PPAT pada transaksi jual beli rumah susun yang di bangun di atas tanah Hak Guna Bangunan di atas Hak Pengelolaan dan pendapat Hakim Perdata atas peran PPAT dalam jual beli rumah susun yang dibangun di atas Hak Guna Bangunan di atas Hak Pengelolaan. Metode penelitian dalam penyusunan tesis ini adalah yuridis normatif, maka Penulis melakukan analisis terhadap peran PPAT dalam pengurusan hak kepemilikan atas satuan rumah susun berstatus Hak Guna Bangunan di atas Hak Pengelolaan. Hasil penelitian dari penulis menemukan bahwa peran PPAT dalam transaksi jual beli atas satuan rumah susun yang dibangun dengan alas Hak Guna Bangunan di atas Hak Pengelolaan tetap harus melakukan pengecekan atas data fisik dan data yurdis dan tetap harus memperoleh persetujuan dari pemilik Hak Pengelolaan dalam hal ini adalah Pemda DKI dan pendapat Hakim pada tingkat banding dan kasasi atas peranan PPAT pada transaksi jual beli satuan rumah susun yang dibangun di atas tanah Hak Guna Bangunan di atas Hak Pengelolaan tersebut adalah keliru.
