Abstract

This study aims to examine " Yuridical Analysis of Cancellation Certificate Rights Building by The Indonesian National Land Office as The Implementation of The Court Decision (Case Study: Decision Number 555 Pdt.G 2012 Pn-Jkt.Pst). The method used in this research is normative juridical approach. According to this approach, the truth must be obtained from the experience and this method provides the framework or test framework to ensure the truth. Test data used in this study is the Central Jakarta District Court's Decision No. 555 Pdt.G 2012 PN.Jkt.Pst is dated 12 November 2013. The results showed that the implementation of land registration has not been able to provide legal certainty and provide legal protection for holders of certificate of land rights for non-performance of the mechanism of land registration in accordance with the procedures of legislation the land sector. In this topic of discussion, the cancellation of the certificate is due to PPAT's inaccuracy in the sale and purchase deed transaction No.26 JB III 1983 dated 21 March 1983 on the object of land dispute with the Land Use Rights (HGB) No.138 Kebon Sirih, thus eliminating legal certainty that should be owned by Plaintiff, PT Sari Graha Mandala. The legal analysis of the rejection of the Plaintiff s lawsuit refers to the case in a special court, namely the judge's decision on the State Administrative Case No.Ol PK TUN 1994 which was decided on 12 October 1994 which among others stated that the Land Use Rights Certificate (HGB) No.138 Kebon Sirih canceled. The verdict has actually provided legal certainty for the real owner, and this is related to the land registration system in Indonesia that embraces a negative publication system containing positive elements. / Penelitian ini bertujuan untuk menguji Analisis Yuridis Pembatalan Sertipikat Hak Guna Bangunan Oleh Badan Pertanahan Nasional Sebagai Pelaksanaan Putusan Pengadilan (Tinjauan Kasus: Putusan Nomor. 555/Pdt.G/2012/Pn-Jkt.Pst). Metode pendekatan yang digunakan dalam penelitian ini adalah metode pendekatan yuridis normatif. Menurut metode pendekatan ini, kebenaran hams diperoleh dari pengalaman dan metode ini memberikan kerangka pemikiran atau kerangka pengujian untuk memastikan suatu kebenaran. Data pengujian yang digunakan dalam penelitian ini adalah Putusan Pengadilan Negeri Jakarta Pusat Nomor:555/Pdt.G/2012/PN.Jkt.Pst Tertanggal 12 November 2013. Hasil penelitian menunjukkan bahwa pelaksanaan pendaftaran tanah belum mampu memberikan kepastian hukum dan memberikan perlindungan hukum bagi pemegang sertipikat hak atas tanah karena tidak terlaksananya mekanisme pendaftaran tanah sesuai dengan prosedur peraturan perundang-undangan bidang pertanahan. Dalam topik bahasan ini pembatalan sertipikat teijadi karena ketidaktelitian PPAT dalam melakukan transaksi akta jual beli No.26/JB/IIl/1983 tertanggal 21 Maret 1983 atas obyek tanah sengketa dengan sertipikat Hak Guna Bangunan (HGB) No. l 38/Kebon Sirih, sehingga menghilangkan kepastian hukum yang seharusnya dimiliki oleh Penggugat, PT Sari Graha Mandala. Analisis hukum penolakan gugatan Penggugat adalah mengacu kepada perkara di peradilan khusus, yaitu putusan Majelis Hakim atas Perkara Tata Usaha Negara No.01 PK/TUN/1994 yang diputus pada tanggal 12 Oktober 1994 yang diantaranya menyatakan sertipikat Hak Guna Bangunan (HGB) No. l 38/Kebon Sirih dibatalkan. Putusan tersebut justru telah memberikan kepastian hukum bagi pemilik yang sesunggguhnya, dan hal ini terkait dengan sistem pendaftaran tanah di Indonesia yang menganut sistem publikasi negatif yang mengandung unsur positif.
