Abstract

Undang-Undang Nomor 16 Tahun 2001 Juncto Undang-Undang Nomor 28 Tahun 2004 Tentang Yayasan disebutkan bahwa Yayasan memiliki harta kekayaan yang dipisahkan, diperuntukan untuk mencapai maksud dan tujuan dibidang sosial, keagamaan, kemanusiaan dan oleh Undang-Undang diberi status badan hukum. Status Yayasan sebagai badan hukum disebutkan dalam Pasal 1 ayat 1 Undang-Undang Nomor 16 Tahun 2001 Juncto Undang-Undang Nomor 28 Tahun 2004 Tentang Yayasan. Status badan hukumYayasan diperoleh setelah akta pendiriannya dibuat dengan akta Notaris, telah disahkan dan diumumkan dalam Tambahan Berita Negara Republik Indonesia. Permasalahan timbul ketika sebuah Yayasan yang bergerak dibidang pendidikan dan sosial dan berkedudukan di Jakarta Selatan pada tahun 1966 dinyatakan sebagai organisasi terlarang, dan dibubarkan oleh pemerintah. Kemudian asset Yayasan tersebut berupa tanah ditetapkan status hukumnya sebagai milik Negara. Pada tahun 1995 asset yang telah disita oleh pemerintah dialihkan oleh Yayasan yang telah dibubarkan oleh pemerintah tersebut kepada Yayasan lain yang juga bergerak di bidang sosial. Dikemudian hari pengalihan ini menimbulkan sengketa hingga keranah hukum. Penulisan Thesis ini bertujuan untuk mengetahui keabsahan akta-akta yang dibuat oleh Notaris atas Yayasan yang telah ditetapkan sebagai organisasi terlarang dan kekuatan hukum peralihannya. Dalam penelitian ini, menggunakan metode penelitian hukum normatif. Dari hasil penelitian tersebut dapat disimpulkan bahwa dalam Undang-Undang Yayasan Pasal 68 disebutkan dalam hal Yayasan bubar maka Yayasan dapat mengalihkan kekayaan Yayasan kepada Yayasan lain yang mempunyai maksud dan tujuan yang sama. Selain itu akta Notaris sebagai akta Otentik memiliki kekuatan pembuktian yang sempurna. Pembatalan daya ikat akta Notaris hanya dapat dilakukan atas kesepakatan para pihak. Keberadaan akta Notaris sebagai akta otentik, mempunyai kekuatan istimewa sebagai alat bukti / Law No. 16 of 2001 Juncto Law Number 28 Year 2004 About the Foundation stated that the Foundation has material possessions separated, intended to achieve the objectives of social, religious, humanitarian and by the Law was given legal status. Foundation status as a legal entity referred to in Article 1, paragraph 1 of Law No. 16 of 2001 Juncto Law Number 28 Year 2004 About the Foundation. The Foundation obtained legal status after its founding act made by Notarial deed, was approved and published in the Gazette Republic of Indonesia. Problems arise when a foundation engaged in education and social and domiciled in South Jakarta in 1966 declared a banned organization, and was disbanded by the government. Then the Foundation assets such as land designated legal status as property of the State. In 1995 the assets that have been seized by the government diverted by the Foundation which has been dissolved by the government to other Foundation is also engaged in the social field. Later this diversion caused disputes to the legal sphere. Thesis writing is intended to determine the validity of Notaries deeds on the Foundation which has been established as a prohibited organization and strength of transitional law. These study use the method of normative legal research. From these results it can be concluded that the Foundation Law Article 68 mentioned in the Foundation disperse the Foundation may transfer wealth to the Foundation Foundation for others who have the same aims and objectives. Additionally Notary deed as authentic deed has the strength of evidence was perfect. Cancellation holding capacity notarial deed can only be done by agreement of the parties. The existence of Notary deed as authentic deeds, having special powers as evidence
