Abstract

Kehidupan manusia tidak dapat terlepas dari keberadaan tanah sebagai ekosistem hidupnya. Jenis kebutuhan ini semakin meningkat mengingat semakin hari populasi manusia semakin banyak. Hal ini berimplikasi kepada kemajuan dalam proses pembangunan nasional. Kemajuan dan tingginya pembangunan yang terjadi membawa konsekuensi bertambahnya jenis masalah dalam proses pembangunan. Masalah tersebut mulai dari sengketa tanah antar perorangan hingga masalah yang muncul akibat tindakan pemerintah yang pro kepada kaum kapitalis. Meskipun pemerintah sudah berupaya untuk mewujudkan keadilan, kesejahteraan, dan kepastian hukum di bidang pertanahan bagi masyarakat melalui berbagai aturan hukum pertanahan hingga pembentukan badan pertanahan, permasalahan tentang tanah sering kali terjadi dan membawa keresahan bagi masyarakat sehubungan dengan hak-hak tanah yang dimilikinya. Dalam penelitian ini, penulis menemukan masalah yang terjadi antara penjual dan pembeli suatu objek tanah yang penerbitan sertipikatnya keliru sehingga menimbulkan masalah dalam proses peralihan hak atas tanah tersebut. Tidak hanya kedua pihak tersebut, pihak bank sebagai kreditur yang memiliki kepentingan karena sudah berkontribusi atas pembeli atau debiturnya dalam melunasi sejumlah harga yang telah disepakati untuk membeli objek tanah tersebut juga mengalami kerugian akibat masalah tersebut. Untuk menemukan preksipsi atas masalah ini, penulis menggunakan jenis penelitian hukum normatif / Human life can not be separated from the existence of land as part of life ecosystem. The need of land is growing along with the rise of human population. Consequently, this condition will affect the advancement of national development. This high advancement will bring newer problem on national development progress. The problem arise from individual land dispute to problem that caused by government action that benefit capitalists sides. Even though government has try their best to actualize civil justice, welfare, and legal certainty in this sector for society through land legal and forming national land agency, this land problem often happened and bring restlessness to society regarding their land rights. On this research, the author found a problem between buyer and seller regarding land transaction which has error on the certificate that caused future problem on the hand-over process. Not only between those sides, bank as the creditor has their own interest because they are contributing to the debtor by paying off the agreed price to buy the land will experience loss because of that problem. To find the right prescriptions, the author use a normative law type of research
