Abstract

Pejabat Pembuat Akta Tanah adalah pejabat umum yang diberi kewenangan untuk membuat akta-akta otentik di bidang pertanahan dan menjadi pelaksana pendaftaran tanah. Dalam melaksanakan tugasnya, PPAT tidak dapat terlepas dari Kantor Pertanahan setempat dimana PPAT wajib mematuhi semua peraturan yang dikeluarkan oleh Kantor Pertanahan. Salah satu bentuk hubungan tersebut adalah terkait dengan prosedur pendaftaran administratif. Pada mulanya, sistem pendaftaran menggunakan sistem manual dimana karyawan dari kantor PPAT mengambil nomor antrian sesuai urutan yang tersedia. Selanjutnya, PPAT yang bersangkutan akan dilayani oleh petugas di kantor pertanahan. Pada saat ini, sistem manual tersebut telah diganti dengan sistem baru dengan menggunakan media on-line setelah diterbitkannya Surat Edaran Menteri Negara Agraria Nomor 5/SE-100/I/ 2015 Tentang Penggunaan Aplikasi Komputerisasi Kegiatan Pertanahan. Melalui media on-line, PPAT memasukkan password dan memasukkan data- data yang diperlukan, kemudian datang ke Kantor Pertanahan untuk melakukan pengecekan berkas asli. Masalah dalam tugas akhir ini meneliti tentang faktor-faktor Pemerintah memberlakukan sistem pendaftaran tanah secara on-line, pertanggungjawaban Pejabat Pembuat Akta Tanah dalam Pendaftaran Tanah berdasarkan sistem on-line dan keefekifan sistem pendaftaran tanah secara on-line dalam menyelesaikan permasalahan pendaftaran tanah di kantor pertanahan. Penelitian ini merupakan penelitian hukum yuridis empiris. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Analisis pembahasan dirangkum secara kualitatif, serta penarikan kesimpulan secara deduktif. Penulis menganalisis bahwa faktor-faktor Pemerintah memberlakukan sistem pendaftaran tanah secara on-line dikarenakan sistem tersebut merupakan wujud dari Penerapan Undang-Undang Nomor 14 Tahun 2008 Tentang Keterbukaan Informasi Publik, sistem pendaftaran tanah secara manual memerlukan waktu lama, menjamin kepastian pelayanan di Kantor Pertanahan, mengurangi praktik kecurangan di Kantor Pertanahan. Sistem tersebut membuat Pejabat Pembuat Akta Tanah memilki kewajiban yang lebih besar kepada masyarakat dan terciptanya tata tertib di Kantor Pejabat Pembuat Akta Tanah. Dalam praktiknya, sistem pendaftaran tanah secara On-Line belum mampu menyelesaikan semua masalah pendaftaran tanah di Kantor Pertanahan akibat hambatan yang berasal dari Kantor Pertanahan dan masyarakat / Land deed official is a public official who is authorized to make the authentic deeds related to land sector and implementing land registration. In performing it’s duties, a land deed official can not be separated from the local land office where that he/she complied and obey all regulations issued by the land office. One form of such relationships is related to the administrative registration procedures. In the past, the land registration system using a manual system where the employees of land deed official took a queue number in the order provided. Furthermore, land deed official would be served by the clerk at the land office. In this present, the manual system has been revised with a new system using on-line media based on regulation of Minister of Agriculture Number 5/SE- 100/I/2015 about Implementation of computerized applications for land procedures activity. Through on-line system, land deed official enters a password and entry the data, then he officer come to the land office to check the original documents. The problem in this thesis examines the factors the government imposed a land registration on-line system, the responsibility of land deed official after implementing of on-line system and effectiveness of on-line system in solving the problems of land registration at the land office. This study is a empiric juridic law research which use analytic descriptive. The sources consist of primary, secondary and tertiary law material. The approach of the analysis uses qualitative method and finally conclusion was drawn through deductive reasoning. The writer analyzed that factors the government imposed a land registration system on-line because the system is a manifestation of the regulation Number 14 in 2008 about publicity of information, a manual land registration spends more time, guaranteeing the service at the land office, and reducing fraudulent practices in land office. The system makes the land deed official has the more obligations to the clients and the create the good arrangement in land deed official office. In practice, the system of land registration by on- line system can not solve all the problems in the land office, carried by the land office and the people itself
