Abstract

Indonesia merupakan negara berkembang, oleh karena itu di dalam usaha peningkatan perekonomiannya dibutuhkan modal dan investasi yang besar, modal tersebut dapat berasal dari pemilik modal dalam negeri (korporasi maupun perorangan) atau pemilik modal asing (korporasi asing maupun perorangan asing). Penanaman Modal di Indonesia diatur dengan Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal. Berdasarkan undang-undang Penanaman Modal nomor 25/2007 tersebut di atas pemerintah memberikan kepastian perlindungan hukum bagi investor baik asing maupun investor dalam negeri yang menanamkan modal di Indonesia. Dikaitkan dengan studi kasus yang akan dibahas dalam tesis ini terutama berkaitan dengan putusan Mahkamah Agung No 32/PK/TUN/2011 dimana dalam kasus itu yang menjadi obyek gugatan adalah pencabutan IzinUsaha Tetap (PTBI) dan surat keputusan Badan Koordinasi Penanaman Modal (PTBI). Sehingga timbul pertanyaan dimana bentuk perindungan hukum terhadap investor asing yang sudah memperoleh izin namun kemudian izin yang diberikan tersebut dicabut. Dimana bentuk perlindungan hukum berupa kepastian hukum bagi investor asing yang telah menanamkan modalnya di Indonesia? Pendekatan yang di gunakan dalam tesis ini adalah metode yuridis normatif / Indonesia is a developing country, therefore, in the efforts to improve the economy and the capital required substantial investment, such capital can be derived from domestic owners of capital (corporate or individual) or the owners of foreign capital (foreign corporations and foreign individuals). Under law number 25/2007 Investment aforementioned government to provide certainty of legal protection for investors, both foreign and domestic investors to invest in Indonesia. Referring to the case study discussed in this thesis mainly deals with the Supreme Court's decision No 32 / PK / TUN / 2011 where in the case who becomes the object of the lawsuit was the removal Business Lisence Equipment (PTBI) and the decree of the Investment Coordinating Board (PTBI). Thus the question arises where is the protection of law to foreign investors who have obtained a license but later revoked the permission granted. Is there legal protection in the form of legal certainty for foreign investors who have invested in Indonesia? The approach used in this thesis is a normative juridical method
