Abstract

The problems of land in society always arise in relation to land registration or the transfer of land rights. There are still frequent disputes over arable land that is not in accordance with clear provisions, the term arable land is not known in Basic Agrarian Law (UUPA), while legislation does not determine specifically about the acquisition of an arable land. As an example of dispute case about arable land that happened in Bogor Regency between PT. Mitra Lima R and PT. Laguna Alam Abadi. This study is a kind of normative juridical research or doctrinal legal research because this research is conducted or directed only to written regulations or other legal materials. This research use secondary data, that is data who support the description or support the completeness of the primary dataobtained from libraries. The approach method is done by reviewing all laws and regulations relating to legal issues being handled. The result of research indicate that procedure of acquisition of land rights claimed by PT. Laguna Alam Abadi has been in accordance with the way of disposal or assignment of priority rights of PT. Pranusa and has made a compensation payment directly to the farmers. Decision of the Supreme Court (MA) No. 46 K/TUN/2016 has been in accordance with legal provisions on land acquisition. In its verdict that rejected the lawsuit from PT. Mitra Lima R because of the Land Agency of Bogor Regency as the defendant in case of issuing the Right to Build Certificate (SHGB) No. 3533 in 2013 over land area of 64.796 m2 on behalf of PT. Laguna Alam Abadi which become object of the dispute has been in accordance with the applicable provisions because of based on the true juridical data with authentic document or deeds about land rights. / Permasalahan tanah dalam masyarakat selalu muncul dalam hubungannya dengan pendaftaran tanah atau peralihan hak atas tanah. Masih sering terjadi adanya perselisihan tanah garapan yang tidak sesuai dengan ketentuan yang jelas, Istilah Tanah Garapan ini tidak dikenal dalam UUPA, sedangkan peraturan perundang-undangan tidak menentukan khusus mengenai perolehan suatu tanah garapan. Sengketa mengenai tanah garapan ini seperti contoh kasus yang terjadi di Kabupaten Bogor antara PT. Mitra Lima R dengan PT. Laguna Alam Abadi. Penelitian ini merupakan jenis penelitian yuridis normatif atau penelitian hukum doktriner karena penelitian ini dilakukan atau ditujukan hanya pada peraturan peraturan yang tertulis atau bahan bahan hukum lainnya Data dalam penelitian ini menggunakan data sekunder, yaitu : data yang mendukung keterangan atau menunjang kelengkapan data primer yang diperoleh dari perpustakaan. Metode pendekatan dilakukan dengan menelaah undang-undang dan regulasi yang bersangkut paut dengan isu hukum yang sedang ditangani. Hasil penelitian menunjukkan bahwa prosedur perolehan hak atas tanah garapan PT. Laguna Alam Abadi telah sesuai dengan cara Pelepasan/Pengoperan Hak Prioritas dari PT. Pranusa dan telah melakukan pembayaran ganti rugi langsung kepada petani penggarap. putusan Mahkamah Agung No. 46 K/TUN/2016 telah sesuai menurut ketentuan hukum perolehan tanah. Dalam putusannya yang menolak gugatan PT. Mitra Lima R dikarenakan Badan Pertanahan Kabupaten Bogor selaku tergugat dalam hal menerbitkan Sertifikat Hak Guna Bangunan (HGB) No. 3533 Tahun 2013 atas tanah seluas 64.796 m2 atas nama PT. Laguna Alam Abadi yang menjadi obyek sengketa telah sesuai menurut ketentuan yang berlaku karena didasarkan pada data yuridis yang benar serta dokumen atau akta otentik mengenai hak atas tanah.
