Abstract

Pemberian kredit merupakan salah satu jenis usaha di sektor perbankan, yaitu menyalurkan dana yang terhimpun dari masyarakat dan menyalurkan kembali kepada masyarakat yang membutuhkan bantuan dana tersebut. Pemberian Kredit Pemilikan Rumah (KPR) merupakan upaya pemerintah sebagai solusi atas kendala yang muncul dimasyarakat dalam hal pemenuhan kepemilikan rumah, guna menunjang pembangunan, dimana diharapkan masyarakat dari semua lapisan dapat berperan serta. Perjanjian Pengikatan Jual Beli lahir sebagai akibat belum terpenuhinya beberapa persyaratan yang ditentukan oleh undang-undang yang berkaitan dengan jual beli hak atas tanah, yang akhirnya menghambat penyelesaian transaksi dalam jual beli hak atas tanah. Persyaratan tersebut ada yang lahir dari peraturan perundang-undangan yang ada dan ada pula yang timbul sebagai kesepakatan para pihak yang akan melakukan jual beli hak atas tanah. Perjanjian Pengikatan Jual Beli (PPJB) dapat dibuat dibawah tangan atau notaril. Perjanjian Pengikatan Jual Beli (PPJB) yang dibuat dihadapan notaris merupakan akta otentik. Dalam kaitannya dengan akta otentik tersebut, Pasal 1870 Kitab Undang-Undang Hukum Perdata telah memberikan penegasan bahwa akta yang dibuat dihadapan notaris memiliki kekuatan pembuktian yang sempurna. Penelitian ini dilakukan untuk melihat secara komperhensif mengenai pengaturan kedudukan Perjanjian Pengikatan Jual Beli (PPJB) sebagai jaminan kredit beragunan properti di bank dengan menggunakan metode penelitian yuridis normatif. Dari hasil penelitian terhadap data sekunder dan pendekatan yang dilakukan dengan menggunakan pendekatan perundang-undangan terhadap Perjanjian Pengikatan Jual Beli sebagai jaminan kredit di bank, yang belum dapat dibebankan hak tanggungan, serta menunjukkan bahwa perlu adanya upaya perlindungan hukum terhadap debitur yang wanprestasi atau cidera janji, serta bagaimana proses eksekusi jaminan yang belum dibebankan hak tanggungan / Giving credit is one type of business in the banking sector, which distribute funds collected from the public and to channel back to the people who need the help of these funds. Lending (mortgages) as the government seeks a solution to the problems that arise in the community in terms of fulfillment of home ownership, in order to support the development, which is expected from all walks of society can participate. Sale and Purchase Agreement was born as a result have not met certain requirements set by the laws relating to the sale and purchase of land rights, which ultimately hinder the settlement of transactions to buy and sell land rights. The existing requirements born of the legislation that exists and some are arising as the agreement of the parties that will make buying and selling land rights. Sale and Purchase Agreement (SPA) can be made under the hand or notaril. Sale and Purchase Agreement (SPA) made before a notary an authentic deed. In connection with the authentic deeds, Article 1870 Book of the Law of Civil Law has provided confirmation that the deed made before a notary have perfect strength of evidence. This study was conducted to look comprehensively on setting the position of the Sale and Purchase Agreement (SPA) as collateral for bank loans backed by collateral properties using normative juridical research method. From the research of secondary data and the approach taken by using the approach of legislation to the Agreement Sale and Purchase Agreement as loan collateral in the bank, which can not be charged a security interest, and indicate that efforts are needed legal protection for debtors who default or breach of contract, and how the execution process guarantees that security right has not been charged
