Abstract

Pentingnya fungsi tanah bagi manusia mengakibatkan sering terjadi sengketa tanah di dalam masyarakat. Salah satu contoh kasus yang diangkat dalam thesis ini adalah sengketa pertanahan antara warga di Kecamatan Teluk Jambe Kabupaten Karawang Provinsi Jawa Barat dengan PT Sumber Air Mas Pratama (“PT SAMP”). Dalam penelitian ini timbul pertanyaan bagaimana kepastian hukum penguasaan tanah dan bagaimana penyelesaian sengketa penguasaan tanah yang telah berlangsung secara turun temurun oleh warga di Kecamatan Teluk Jambe Kabupaten Karawang. Jenis penelitian ini adalah penelitian yuridis normatif dengan metode penelitian melalui studi kepustakaan dan pendekataan undang-undang serta dengan menggunakan metode penarikan kesimpulan deduktif. Berdasarkan hasil analisis dapat disimpulkan bahwa 1) Penguasaan secara fisik yang dilakukan oleh warga Teluk Jambe selama ini harus didukung dengan adanya penguasaan secara yuridis yang berupa pendaftaran hak atas tanah yang demi terciptanya kepastian hukum bagi warga Teluk Jambe sendiri. 2) Penyelesaian sengketa pertanahan antara warga Teluk Jambe dengan PT SAMP dapat diselesaikan melalui upaya mediasi yang dilandasi dengan itikad baik dari kedua belah pihak. Dalam upaya mediasi ini BPN Kabupaten Karawang dapat ditujuk sebagai mediator, karena BPN Kabupaten Karawang dianggap mengetahui mengenai sengketa tersebut dari awal dan diharapkan dapat mengakomodasi kepentingan-kepentingan para pihak yang bersengketa. 3) Sarannya adalah sebaiknya bagi warga Teluk Jambe yang masih memegang girik atau Leter C dapat mendaftarkan tanahnya segera untuk mendapatkan bukti kepemilikan berupa sertipikat hak atas tanah di BPN Kabupaten Karawang demi adanya kepastian hukum terhadap tanah yang dikuasai / The importance of land for human being has resulted in the frequent occurrence of land dispute in societies. One of the cases that is being highlighted in this thesis is the land dispute between the residents in Teluk Jambe Sub District, Karawang District, with PT Sumber Air Mas Pratama (“PT SAMP”). In the present research, the question arises on how legal certainty is exercised with respect to land possession and how settlement of dispute is practiced with regards to hereditary land possession by the between the residents of Teluk Jambe Sub District, Karawang District. This type of research is a legal normative research conducted through bibliographical study and laws approach with deductive conclusion method. Based on the analysis it can be concluded that 1) Physical possession done by the residents of Teluk Jambe all this time has to be supported by juridical/legal possession in the form of registration of rights over land for the purpose of legal certainty for the residents of Teluk Jambe themselves. 2) Settlement of dispute between the residents of Teluk Jambe and PT SAMP can be done through mediation based upon good faith from both sides. Through mediation, BPN of Karawang District can be appointed as mediator, because BPN of Karawang District can be regarded to know the dispute from the beginning and is expected to be able to accommodate the interests of disputing party. 3) It is suggested for the residents of Teluk Jambe that still hold girik or Letter C to register their respective land immediately to obtain certificate of entitlement from the BPN of Karawang District for legal certainty purpose
