Abstract

Jual beli adalah salah satu perbuatan hukum yang mendasari suatu peralihan hak atas tanah yang yang harus dilakukan dihadapan Pejabat yang berwenang yaitu Pejabat Pembuat Akta Tanah (PPAT). Salah satu syarat pendaftaran hak atas tanah dilakukan jika dibuktikan dengan akta yang dibuat oleh PPAT sesuai ketentuan Perundang – Undangan. Pada prosesnya pengalihan hak dilakukan melalui Jual Beli dihadapan Pejabat Pembuat Akta Tanah tetapi adakalanya proses tersebut didahului oleh suatu Perjanjian permulaan yang lebih dikenal dengan Perjanjian Pengikatan Jual Beli yang dibuat dihadapan Pejabat yang berwenang yaitu Notaris. Dalam hal Perjanjian Pengikatan Jual Beli dibatalkan oleh para pihak karena tidak dapat memenuhi unsur subjektif perjanjian maka berakibat pada batalnya perjanjian tersebut namun tidak serta merta mengembalikan pada keadaan semula sebelum diadakannya perjanjian. Jual beli yang dilakukan berdasarkan pada Perjanjian Pengikatan Jual Beli yang dibatalkan akan berakibat pada tidak terpenuhinya syarat objektif perjanjian sehingga secara hukum jual beli tersebut dianggap batal demi hukum. Metode yang digunakan oleh Penulis adalah pendekatan yuridis normatif yang digunakan dalam penelitian yang bersifat analitis dan deskriptif. Berdasarkan hal – hal sebagaimana dijelaskan sebelumnya, maka Penulis akan mengkaji permasalahan – permasalahan yang timbul seputar latar belakang dilaksanakannya Perjanjian Pengikatan Jual Beli termasuk akibat hukum pembatalan atas Perjanjian Pengikatan Jual beli dan implikasi hukumnya terhadap Akta Jual Beli yang dilaksanakan atas dasar Perjanjian Pengikatan Jual beli yang telah dibatalkan. Berdasarkan hasil penelitian dan analisa, maka dapat diambil kesimpulan bahwa hal – hal yang mendasari dilakukannya Perjanjian Pengikatan Jual beli adalah belum dilunasinya pembayaran atas obyek tanah yang diperjualbelikan oleh Pembeli kepada Penjual, atau belum dapat dibayarkannya pajak – pajak yang timbul atas jual beli tanah yang akan dilakukan, dan terdapat pula kekurangan dokumen – dokumen lainnya dalam rangka jual beli yang akan dilakukan dihadapan Pejabat Pembuat Akta Tanah (PPAT) / Sale and purchase is one of the legal actions that constitute a transfer of rights over land that should be done before the competent authority, namely the Land Deed Official (PPAT). One of the conditions of registration of land rights do if proven by deed made by PPAT accordance with Regulations - Invitation. In the process the transfer of rights is done through the front of the Sale and Purchase Deed Official Land but sometimes the process is preceded by an agreement starters, better known by the Sale and Purchase Agreement made before a competent authority, namely the Notary. In terms of the Sale and Purchase Agreement is canceled by the parties being unable to satisfy the subjective element of the agreement results in the cancellation of the agreement but did not restore the original condition prior to the agreement. Sale and purchase based on the Sale and Purchase Agreement is canceled will result in non-fulfillment of objective conditions so that the agreement is legally purchase shall be deemed null and void. The method used by the author is a normative juridical approach used in research that is both analytical and descriptive. Based things - things as explained earlier, the author will study the problems - problems that arise around the background implementation of the Agreement Sale and Purchase Agreement including the legal effect of cancellation on Agreements Sale and purchase and the legal implication of the Sale and Purchase Agreements are implemented based on the Treaty Sale and purchase has been canceled. Based on the results of research and analysis, it can be concluded that - the underlying does Agreements Sale and purchase is nonpayment payment of ground objects are bought and sold by the Buyer to the Seller, or can not pays taxes - taxes incurred on the sale and purchase of land that will be done, and there is also a shortage of documents - other documents in order to purchase that will be done before the Land Deed official (PPAT)
