Abstract

Notary is public official that authorized to make an authentic deed and other according to law regulations. Notary has been appointed and terminated by the minister, however Notary is not a government workers. Notary was believed by the public and nations to exercise their authority. In running their duty, a Notary should always obey the rules according to the code of conduct that made by the organization and the law regulation. The code of conduct was made to manage the Notary to be honest, straight, fair, and to keep their value and dignity as a public official and as a person who provide services to the public. Therefore, a Notary who disobey the law and the code of conduct will subject to a penalt. / Notaris merupakan pejabat umum yang berwenang untuk membuat akta otentik dan kewenangan lain sesuai dengan ketentuan undang – undang. Notaris diangkat dan diberhentikan oleh Menteri, akan tetapi seorang Notaris bukan merupakan pegawai negeri. Notaris merupakan jabatan kepercayaan yang dipercaya oleh masyarakat dan negara untuk melaksanakan tugasnya. Dalam menjalankan jabatannya, seorang Notaris harus tunduk kepada undang – undang jabatan Notaris, dan Kode Etik Notaris yang dibentuk oleh perkumpulan. Kode Etik Notaris yang dibuat bertujuan untuk melakukan penataan kepada Notaris, salah satunya ketentuan dalam Pasal 4 ayat (3) Kode Etik Notaris tentang larangan promosi. Selain itu juga bertujuan agar setiap orang yang menjalankan jabatan Notaris dapat lebih bertinndak hati – hati dan selalu bersikap jujur, amanah, dan disiplin dan sebisa mungkin memenuhi persayaratan – persyaratan yang di tetapkan oleh undang – undang di dalam menjalankan tugas jabatannya, demi kepentingan pelayanan kepada masyarakat. Oleh karena itu baik terhadap pelanggaran undang – undang maupun pelanggaran Kode Etik yang dilakukan oleh Notaris dapat dikenakan sanksi.
