Abstract

Statement Letter of Land Registration (SKPT) is a letter containing information of the annotations in the land title certificate. As referred asinformation in such statement letter meansis information concerning the physical data and / or the juridical data upon the land rights. SKPT containing the latest annotation of the land title certificate, annotation concerning blocking landannotation concerning the encumbrance of mortgage right on land title. In connection with the process of taking over sale and purchase, if the parties executing the deed of transfer of rights and the encumbrance of mortgage right before the Notaryand/or PPAT as referring to the SKPT, then it can be deemed as invalid. Consequently, such executed deed shall be legally error and therefore shall be deemed as null and void. From the legal perspective such matter may result on the absence of legal certainty against such executed deed. This research is normative legal research. As it using the literature or document studies from library materials as the research data. Based on the results of the research, the sale and purchase process may not be completed because the fact of the original land title certificate is still possessed bythe bank/ initial creditor, which it may hamper the completion of the obligatory matters prior to deed execution, examination on the on the originality of the certificate in the National Land Agency, payment of the tax obligated to each of the seller and the buyer, and against such tax shall be initially reviewed by the local Tax office. / Surat Keterangan Pendaftaran Tanah (SKPT) adalah surat yang memuat informasi mengenai catatan-catatan atas sertipikat hak atas tanah. Yang dimaksudkan informasi tersebut adalah informasi mengenai data fisik dan atau data yuridis atas hak atas tanah. SKPT berisi catatancatatan terakhir dari sertipikat hak atas tanah seperti, catatan mengenai blokir, catatan mengenai pembebanan hak tanggungan atas tanah, dan lain sebagainya. Sehubung dengan proses take over jual beli, apabila para pihak menandatangani akta peralihan hak maupun pembebanan hak tanggungan dihadapan Notaris dan/atau PPAT dengan mengacu pada SKPT maka hal tersebut dapat dianggap tidak sah, akibatnya, terhadap akta yang sudah di tanda-tangani tersebut adalah cacat hukum dan karenanya dianggap batal demi hukum. Ditinjau dari aspek hukum, hal tersebut dapat menyebabkan adanya ketidakpastian hukum atas akta yang ditandatangani. Penelitian ini adalah penelitian yuridis normatif, yang menggunakan literature atau studi dokumen dari bahan-bahan pustaka sebagai data penelitian. Berdasarkan hasil penelitian dapat diketahui bahwa proses take over jual beli belum dapat dilakukan karena sertipikat asli masih dikuasai oleh bank/kreditur yang lama, yang mana hal tersebut dapat menghambat hal-hal yang harus dilakukan sebelum penandatangan akta, seperti pengecekan terhadap asli sertipikat di Badan Pertanahan Nasional setempat, melakukan pembayaran pajak-pajak yang menjadi kewajiban dari penjual maupun pembeli serta terhadap pajak-pajak tersebut harus dilakukan penelitian terlebih dahulu di Kantor Pajak setempat.
