Abstract

Nowadays, people are interested to purchase plot of land for cemetery purpose. Taman Kenangan Lestari managed by PT. Alam Hijau Lestari, is one of the cemetery that sales its plot land for cemetery purpose. The action that people take to purchase plot cemetery is not proven by sales and purchase deed made in front of land deed officer. Therefore without this deed, it is not registered in the land office. Problem in this research is legal relation between the owner of plot cemetery with their land and the legal evidence that the owner had. According from problem in this research, and then purpose of this research is to analyze legal relation and legal evidence that obtained by the owner of plot cemetery. This research is a normative legal research or library research, review from primary legal material. Based on result of the research, the legal relation between the owner of plot cemetery and its land is based on agreement between the parties that gives the owner to use the cemetery land. This agreement is made between PT. Alam Hijau Lestari as the manager of Taman Kenangan Lestari and the people that purchase the plot cemetery in Taman Kenangan Lestari. Moreover, the strength of evidence that the owner of plot cemetery had is a certificate that issued by PT. Alam Hijau Lestari. This certificate is only binding its parties because it is not issued by National Land Agency. / Saat ini, orang-orang tertarik untuk membeli kaveling tanah untuk tujuan pemakaman Taman Kenangan Lestari dikelola oleh PT. Alam Hijau Lestari, adalah salah satu pemakaman yang menjual kaveling tanahnya untuk tujuan pemakaman. Perbuatan yang dilakukan oleh orang untuk membeli kaveling makam tersebut tidak dibuktikan dengan perjanjian jual beli yang dibuat oleh dan dihadapan Pejabat Pembuat Akta Tanah. Oleh karena itu tanpa perjanjian tersebut maka perbuatan tersebut tidak terdaftar di Badan Pertanahan Nasional. Isu hukum dalam penelitian ini adalah hubungan hukum antara pemilik kaveling makam dengan tanahnya dan kekuatan pembuktian yang dimiliki oleh pemilik kaveling. Berdasarkan isu hukum tersebut, maka tujuan penelitian ini adalah menganalisa hubungan hukum dan kekuatan pembuktian yang dimiliki pemilik kaveling tanah makam. Jenis penelitian yang digunakan adalah penelitian normatif atau studi kepustakaan, serta berdasarkan bahan hukum primer. Berdasarkan hasil penelitian dalam penelitian ini, hubungan hukum antara pemilik kaveling makan dengan tanahnya lahir karena perjanjian hak guna pemakaman. Perjanjian ini dibuat antara PT. Alam Hijau Lestari selaku pengelola Taman Kenangan Lestari dengan orang yang membeli kaveling makam di Taman Kenangan Lestari. Selain itu, kekuatan pembuktian yang diperoleh pemilik kaveling makam adalah sertifikat yang diterbitkan oleh PT. Alam Hijau Lestari. Sertifikat tersebut hanya mengikat kedua belah pihak karena bukan sertifikat yang diterbitkan oleh Badan Pertanahan Nasional.
