Abstract

The registration of fiduciary guarantee is an obligation that must be done by fiduciary receiver as a form of legal certainty that will be received, but there was imposition of fiduciary guarantee that was late carried out by the fiduciary recipient and the proxy for fiduciary guarantee registration in this case a notary. The problem to be examined is "whether the late fiduciary guarantee deed registered online can provide legal protection for creditors and regarding accountability to a notary who was late in registering an online fiduciary acte. In this research, the writer used normative juridical type, with the approach method, namely the legislative approach and the conceptual approach related to legal issue. This research discussed about the obligation to register a fiduciary guarantee acte. From this research, it is known that fiduciary guarantee have executorial power, unfortunately registration of fiduciary guarantee in Indonesia is still often problematic. The notary in its implementation must be responsible for making and registering the fiduciary acte to the fiduciary registration office on time, so that the fiduciary recipient get legal certainty and fulfill the principle of publicity. The notary will provide a solution to the creditor to make an affirmation acte by a Notary on fiduciary guarantee acte previously signed so that it can be re-registered and if a acte has been issued then legal protection for creditors becomes preferment creditor. Second, a Notary can be subject to administrative sanction in accordance with the negligence that has been made and if the notary prove to be detrimental to the parties concerned, the notary is obliged to compensate the party who suffered the loss in the form of compensation, interest and penalties based on the decision of the judge who has permanent legal force. / Pendaftaran jaminan fidusia yang merupakan kewajiban yang harus dilakukan oleh Penerima fidusia sebagai bentuk dari kepastian hukum yang akan diterimanya, akan tetapi masih terdapat pembebanan jaminan fidusia yang terlambat dilakukan oleh Penerima fidusia maupun Penerima kuasa atas pendaftaran jaminan fidusia tersebut dalam hal ini Notaris, permasalahan yang hendak dikaji adalah apakah akta jaminan fidusia yang terlambat didaftarkan secara online dapat memberikan perlindungan hukum bagi kreditur serta mengenai tanggung gugat terhadap notaris yang terlambat mendaftarkan akta jaminan fidusia secara online. Dalam penelitian ini, penulis menggunakan jenis penulisan yuridis normatif, dengan metode pendekatan yaitu pendekatan perundang-undangan dan pendekatan konseptual yang berhubungan dengan isu hukum yang menjadi pembahasan dalam penelitian ini yaitu kewajibab pendaftaran akta jaminan fidusia. Dari penelitian ini diketahui bahwa jaminan fidusia memiliki kekuatan eksekutorial, sayangnya pendaftaran jaminan fidusia di Indonesia masih sering bermasalah, Notaris sendiri dalam pelaksanaannya harus bertanggungjawab membuat dan mendaftarkan akta jaminan fidusia ke kantor pendaftaran fidusia dengan tepat waktu, sehingga penerima fidusia mendapatkan kepastian hukum serta memenuhi asas publisitas. Pihak notaris akan memberikan solusi kepada pihak kreditur agar membuat akta penegasan oleh Notaris terhadap akta jaminan fidusia yang telah ditandatanani sebelummnya sehingga dapat didaftarkan kembali dan jika telah terbit sertifikat jaminan fidusia maka perlindungan hukum bagi kreditur menjadi kreditur preferent. Kedua, Notaris dapat dikenai sanksi administratif sesuai dengan kelalaian yang telah dibuat dan apabila notaris tersebut terbukti dapat merugikan pihak yang berkepentingan maka notaris tersebut diwajibkan mengganti kerugian terhadap pihak yang mengalami kerugian tersebut baik berupa sanksi ganti rugi, bunga, dan denda berdasarkan putusan hakim yang telah berkekuatan hukum tetap.
