Abstract

Indonesia is a legal country that has legislation on land registration, but until today there are still many land disputes registered in the court, why does it happen? Are the regulations ineffective in providing solutions? In the writing of this Thesis, the main topic is the dispute in the registration of land between the land physical occupation against the owner of the Hak Guna Bangunan certificate which has reach its validity period. This dispute involves government agencies, Land Land Office Registration, RT / RW, Lurah, Camat, and Provincial Government DKI Jakarta. Is it within the jurisdiction of those agencies to perform their duties according to their duties and authorities? Do they provide solutions already under applicable land laws? How do they perceive this dispute in their respective perspectives? The aim of this research is to learn the practice of land registration, to analyze the practice of land sale and purchase by using the title of Statement Letter of Land Physical Occupation, to analyze the recognition of Statement Letter of Land Physical Occupation in the implementation of land registration in Land Regional Office of West Jakarta, to learn expired authentic ownership legal standing in land register, and to discover who is justified in land register between land physical occupation without authentic deed versus expired authentic ownership. / Indonesia adalah negara hukum yang telah memiliki peraturan perundangundangan tentang pendaftaran tanah, namun hingga saat ini masih banyak sengketa pertanahan yang didaftarkan di pengadilan, mengapa hal itu terjadi? Apakah peraturan-peraturan tersebut tidak efektif dalam memberikan solusi? Dalam penulisan Tesis ini yang menjadi topik utama adalah sengketa dalam pendaftaran tanah antara Penguasa fisik tanah melawan pemilik sertifikat Hak Guna Bangunan yang telah berakhir masa berlakunya, Sengketa ini melibatkan instansi pemerintahan, Badan Pertanahan, RT/RW, Lurah, Camat, dan Pemerintah Provinsi DKI Jakarta. Apakah dalam kewenangan bertindaknya instansi-instansi tersebut telah menjalankan tugasnya sesuai tugas dan wewenang mereka? Apakah mereka memberikan solusi sudah berdasarkan undang-undang pertanahan yang berlaku? Bagaimanakah mereka memandang sengketa ini dalam perspektif masingmasing? Tujuan penelitian ini adalah untuk mengetahui praktek pendaftaran tanah, untuk menganalisa praktek jual beli tanah menggunakan surat pernyataan penguasaan fisik bidang tanah, untuk menganalisa pengakuan surat pernyataan penguasaan fisik bidang tanah dalam pelaksanaan pendaftaran tanah pada kantor pertanahan jakarta barat, untuk mempelajari status pemegang hak guna bangunan yang sudah berakhir masa berlakunya dalam pendaftaran tanah, dan untuk menemukan siapakah yang berhak secara hukum untuk mendaftarkan tanah tersebut antara penguasa fisik tanpa alas hak otentik melawan kepemilikan HGB yang telah berakhir masa berlakunya.
