Abstract

This thesis examines the enforceability of Article 74 of Law Number 40 of 2007 on Limited Personnel which regulates the Company engaged in Natural Resources having an obligation to carry out Social and Environmental Responsibility for the community. Seeing the development of Natural Resources Business is increasing but there are still many people around the place where business activities have not directly get the social welfare as regulated in the Legislation because the unclear legislation in the regulation of Social and Environmental Responsibility for the community concretely As well as written on the mutual agreement that has the power of law. There are still many companies that are engaged in the Natural Resources Sector not yet fully implementing the Laws and Regulations. One example if within a year the company engaged in Natural Resources must provide Social and Environmental Responsibility to the Community but what is given can prosper the community as a whole if done only once a year. Due to the unclear legislation regarding Social and Environmental Responsibility, the company engaged in Natural Resources is still not fully to provide the welfare of the community around the company's activities. Therefore, in this case the Notary is a profession authorized to make a written agreement which has legal force between the company and the society in which the agreement contains the agreement of the company to carry out the Social and Environmental Responsibility to the Community. / Tesis ini meneliti tentang keberlakuan Pasal 74 Undang-Undang Nomor 40 tahun 2007 tentang Perseoran Terbatas yang dimana mengatur tentang Perusahaan yang bergerak dibidang Sumber Daya Alam mempunyai kewajiban untuk melaksanakan Tanggung Jawab Sosial dan Lingkungan bagi masyarakat. Melihat perkembangnya Usaha Sumber Daya Alam yang meningkat tetapi masih banyak juga masyarakat disekitaran tempat kegiatan usaha tersebut belum secara langsung mendapatkan kesejaterahan sosial sebagaimana yang diatur dalam Peraturan Perundang-Undangan karena ketidakjelasan peraturan Perundangundangan dalam mengatur tentang Tanggung Jawab Sosial dan Lingkungan bagi masyarakat secara kongkrit. Masih banyak perusahaan yang bergerak di Bidang Sumber Daya Alam belum sepenuhnya menjalakan perintah Peraturan Perundangundangan tersebut. Salah satu contoh apabila dalam satu tahun perusahaan yang bergerak dibidang Sumber Daya Alam harus memberikan Tanggung Jawab Sosial dan Lingkungan kepada Masyarakat tetapi apakah yang diberikan dapat mensejahterakan masyarakat secara menyeluruh jika dilakukan hanya satu kali dalam satu tahun. Karena masih belum jelasnya Peraturan Perundang-undangan tentang Tanggung Jawab Sosial dan Lingkungan ini perusahaan yang bergerak dibidang Sumber Daya Alam masih banyak belum sepenuhnya untuk memberikan kesejahteraan masyarakat disekitar kegiatan perusahaan tersebut. Maka dengan demikian dalam hal ini ialah Notaris sebagai profesi yang berwenang membuat suatu kesepakatan tertulis yang mempunyai kekuatan hukum antara perusahaan dengan masyarakat yang dimana kesepakatan tersebut berisikan perjanjian pihak perusahaan untuk menjalankan Tanggung Jawab Sosial dan Lingkungan kepada Masyarakat.
