Abstract

Notaris adalah pejabat umum yang berwenang membuat akta otentik dan memiliki kewenangan lainnya sebagaimana dimaksud dalam Undang-Undang tentang Jabatan Notaris. Sebagai akta otentik, Perjanjian Pengikatan Jual Beli Tanah pada prinsipnya sama dengan perjanjian pada umumnya yang tunduk pada syarat-syarat sahnya suatu perjanjian. Salah satu syaratnya adalah keharusan para pihak melaksanakan dengan itikad baik. Apabila tidak sesuai dengan persyaratan itu, maka dianggap telah terjadi wanprestasi. Untuk itu, salah satu pihak dapat mengajukan pembatalan pengikatan jual beli tersebut. Penelitian ini difokuskan pada tujuan untuk mengkaji aspek hukum dari tindakan wanprestasi atas pengikatan jual beli yang dibuat dalam bentuk akta otentik. Metode penelitian yang digunakan adalah penelitian hukum normatif. Berdasarkan hasil penelitian dapat kiranya disimpulkan bahwa Notaris dalam melaksanakan jabatannya harus membuat akta sesuai dengan fakta yang terjadi dan harus lebih hati-hati serta lebih cermat. Hal itu penting agar tidak mengakibatkan kerugian pada pihak lain karena kelalaian notaris dalam menjalankan tugasnya / A notary is public official authorized to make an authentic deed and has other authority as referred to law on public Notary. As an authentic deed, the agreement on building procurement of land in principle is the same as an agreement in general which is subject to term concerning the validity of covenant. One of the requirement is the parties commitment to implement it with good faith. If the implementary is not in accordance with the requirement, then there has been a wanprestasi. With this, one of the parties has the right to propose the cancellation of the binding sales purchase agreement. This research is focused on the the purpose of looking at the legal aspects of the act of wanprestasi over binding sales purchase agreement who made in the form of an authentic deed. Research methods that were used is juridisch normative. Based on the research result, it can be concluded that the notary in carrying out his position to make deed has to be in accordance with the fact and must be more careful as well as closer attention. With this, it may not make a damage on other parties due to negligence of notary in carrying out their duties
