Abstract

Transportation is an important need for economy, legal, and social activities in societies, especially in a metropolitan city such as Jakarta. The development of technology which improves transportation is affecting transportation system which is intergrated by online system based on internet. This online system produces many online taxi services which become the “rival” of conventional taxi. In this thesis, the writer conducted a legal research. In this thesis, the writer analyzed the legal materials which set the conditions concerning online taxi and conventional taxi in Jakarta. The legal materials used in this study are Law Number 22 of 2009 regarding Traffic and Transportation and Regional Regulation of DKI Jakarta Number 5 of 2014 regarding Transportation. In order to study this legal aspect, the writer focused on the condition problems about organizing public transportation and online taxi in Jakarta and rules to make colaboration between online taxi and conventional taxi. The research method conducted in this thesis is normative research method. This method is based on the norms or rules in Law and Regional Regulation. The writer used qualitative analysis in this study. The result of this study, the writer found that the legal patronage for online taxi prevents demonstration/rally that caused by envy from conventional taxi drivers who already know by society before. The writer suggests that goverments must show neutrality to both parties either online taxi or conventional taxi. Goverment should invite online taxi company to colaborate with conventional taxi, or issue a law to organize symbiote between online taxi and conventional taxi and this law should be conducted so that this symbiosis makes both parties profitable. / Transportasi merupakan kebutuhan penting dalam kegiatan ekonomi, hukum, dan sosial di masyarakat, terutama di kota metropolitan seperti Jakarta. Pengembangan dari Teknologi yang meningkatkan transportasi mempengaruhi sistem transportasi yang ada terintegrasi dengan sistem online berbasis internet. Sistem online ini menghasilkan banyak layanan taksi online yang menjadi “saingan” taksi konvensional. Dalam tesis ini, file penulis melakukan penelitian hukum. Dalam skripsi ini penulis menganalisis hukum bahan yang mengatur ketentuan tentang taksi online dan taksi konvensional di Jakarta. Bahan hukum yang digunakan dalam penelitian ini adalah Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan serta Peraturan Daerah DKI Jakarta Nomor 5 Tahun 2014 tentang Transportasi. Untuk mengkaji aspek hukum ini penulis fokus dengan syarat permasalahan tentang penyelenggaraan angkutan umum dan taksi online masuk Jakarta dan aturan untuk melakukan kolaborasi antara taksi online dan taksi konvensional. Itu Metode penelitian yang dilakukan dalam tesis ini adalah metode penelitian normatif. Metode ini didasarkan pada norma atau aturan dalam Undang-undang dan Peraturan Daerah. Penulis dulu analisis kualitatif dalam penelitian ini. Hasil penelitian ini, penulis menemukan bahwa perlindungan hukum untuk taksi online mencegah demonstrasi / unjuk rasa yang disebabkan oleh rasa iri pengemudi taksi konvensional yang sudah dikenal masyarakat sebelumnya. Penulis menyarankan bahwa pemerintah harus bersikap netral kepada kedua belah pihak baik taksi online maupun taksi konvensional. Pemerintah sebaiknya mengundang perusahaan taksi online untuk bekerja sama taksi konvensional, atau mengeluarkan undang-undang untuk mengatur symbiote antara taksi online dan taksi konvensional dan undang-undang ini harus dilakukan agar simbiosis ini menjadikan keduanya pihak yang menguntungkan.
