Abstract

Dalam tesis ini, yang dimaksud dengan legalisasi dokumen adalah tindakan pengesahan tanda tangan pejabat yang berwenang terhadap suatu dokumen yang dibuat oleh pihak tertentu di luar negeri. Secara normatif, Pemberian legalisasi dokumen oleh Perwakilan Republik Indonesia (RI) dan instansi pemerintah lainnya didasarkan pada persyaratan dan kondisi tidak adanya implikasi hukum yang akan merugikan Pemerintah RI, tidak bertentangan dengan peraturan perundang-undangan dan berada tidak di luar wewenang serta ketentuan yang berlaku. Penulisan tesis ini menggunakan Metode Penelitian Kepustakaan yang bersifat yuridis-normatif, dengan data sekunder yang diperoleh dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Berdasarkan hasil penelitian, dapat disimpulkan bahwa legalisasi yang dilakukan oleh Perwakilan RI hanya merupakan pengesahan keaslian cap dan atau tanda tangan dan tidak menyatakan keabsahan isi dokumen yang dilegalisasi. Atas dasar itu,, semua pihak yang berkepentingan di Indonesia harus menolak dokumen-dokumen yang tidak atau belum dilegalisasi sebagaimana diatur dalam Peraturan Menteri Luar Negeri Nomor 09/A/KP/XII/2006/01tentang Panduan Umum Tata Cara Hubungan dan Kerjasama Luar Negeri oleh Pemerintah Daerah, dimana dalam Peraturan Menteri Luar Negeri Nomor 09/A/KP/XII/2006/01tersebut dinyatakan bahwa dokumen yang dibuat atau diterbitkan di luar negeri dan akan digunakan di Indonesia, harus dilegalisasi oleh Perwakilan RI di negara setempat / In this thesis, definition of legalization of documents is the act of endorsing the official's signature on the authority of a document created by a particular party overseas. Normatively, the granting of legalization of documents by the Representative of the Republic of Indonesia (RI) and other government agencies is based on the terms and conditions of the absence of legal implications that would harm the Government of the Republic of Indonesia, not in contravention of laws and regulations and are not outside the applicable powers and regulations. The writing of this thesis uses literature research method that is juridical- normative, with secondary data obtained from primary law material, secondary law material and tertiary legal material. Based on the result of this research, it can be concluded that the legalization done by RI Representative is merely an endorsement of the authenticity of the stamp and / or signature and does not state the validity of the contents of the legalized document. On that basis, all interested parties in Indonesia must reject documents which are not or have not been legalized as stipulated in the Regulation of the Minister of Foreign Affairs No. 09/A/KP/XII/2006/01 on the General Guidelines of Procedures for Relations and Cooperation Abroad by The Regional Government, where in the Regulation of the Minister of Foreign Affairs No. 09 / A / KP / XII / 2006/01 states that documents created or issued abroad and to be used in Indonesia shall be legalized by the Indonesian Representative in the local country
