Abstract

Peran wakaf sebagai pranata keagamaan yang tidak hanya bertujuan menyediakan berbagai sarana ibadah dan sosial, tetapi juga memiliki kekuatan ekonomi yang berpotensi, antara lain untuk memajukan kesejahteraan umum, sehingga perlu dikembangkan dan ditingkatkan pemanfaatannya sesuai dengan prinsip syariah, oleh karena itu Peraturan pemerintah Nomor 28 Tahun 1977 dianggap tidak mengakomodir lagi pengaturan tentang wakaf sehingga diubah dengan Undang-Undang Nomor 41 Tahun 2004. Untuk itu permasalahan utama yang ingin dijawab dalam penelitian ini adalah apa urgensi perubahan Peraturan Pemerintah Nomor 28 Tahun 1977 dengan Undang-Undang 41 Tahun 2004 dan bagaimanakah kewenangan notaris dalam pembuatan akta ikrar wakaf tanah. Dalam penulisan ini menggunakan pendekatan undang-undang, Pendekatan ini dilakukan dengan menelaah semua peraturan perundang-undangan yang bersangkut paut dengan permasalahan (isuhukum) yang sedangdihadapi.Kemudian data yang diperoleh disajikan secara deskriptif dan dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa, Undang-undangNomor 41 Tahun 2004 tentang wakaf sebagai pengganti Peraturan pemerintah Nomor 28 Tahun 1977 adalah untuk meningkatkan peran wakaf sehingga dapat meningkatkan kesejahteraan umum. Oleh karena itu di dalam Undang-undang Nomor 41 Tahun 2004 terdapat perluasan dimana wakaf tidak hanya sebatas benda tidak bergeraksaja, tetapi juga meliputi benda bergerak. Konsep wakaf mengandung dimensi yang sangat luas meliputi harta tidak bergerak maupun yang bergerak, termasuk wakaf uang yang penggunaannya sangat luas, tidak terbatas untuk pendirian tempat ibadah dan social keagamaan saja. Selanjutnya, Kewenangan notarisu ntuk membuat Akta Ikrar wakaf telahdiatur di dalam Peraturan Pemerintah Nonor 42 Tahun 2006 tentang PelaksanaanUndang-undang Nomor 41 Tahun 2004 tentang Wakaf Pasal 37 ayat (4), Peraturan Menteri Agama Nomor 73 Tahun 2013 tentang Tata Cara Perwakafan Benda Tidak Bergerak dan Bergerak Selain Uang Pasal 27, dan Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-UndangNomor 30 Tahun 2004 Tentang Jabatan Notaris Pasal 15 / The role of waqf as a religious institution that not only aims to provide various religious and social facilities, but also has potential economic power, among others, to promote the general welfare, so it needs to be developed and improved utilization in accordance with the principles of sharia, therefore Government Regulation Number 28 Year 1977 is considered not to accommodate the regulation of waqf so that it is changed with Law No. 41 of 2004. For that the main problem to be answered in this research is what is the urgency of change Government Regulation No. 28 of 1977 with Law 41 of 2004 and how the authority of notary in making the pledge of land awakening pledge. In this paper using the approach of the law, This approach is done by reviewing all laws and regulations related to the problem (legal issues) that be faced. After obtained data presented descriptively and analyzed qualitatively. The result of the research shows that Law Number 41 Year 2004 regarding wakaf as a substitute of Government Regulation Number 28 Year 1977 is to increase the role of waqf in order to improve the general welfare. Therefore, in Law Number 41 Year 2004 there is an extension where wakaf is not only limited to non-moving objects, but also includes moving objects. The concept of waqf contains a very wide dimension including immovable and mobile property, including wakaf money which is very wide use, not limited to the establishment of places of worship and religious social only. Furthermore, the notarial authority to make the pledge of Wakaf Pledge has been regulated in the Government Regulation Nonor 42 of 2006 concerning the Implementation of Law Number 41 Year 2004 regarding the Endowment Article 37 paragraph (4), Regulation of the Minister of Religious Affairs Number 73 Year 2013 on Procedures for Performation of Unmovable and Moving Other than Money Article 27, and Law Number 2 Year 2014 on Amendment to Law Number 30 Year 2004 Concerning Position of Notary Article 15
