Abstract

Perjanjian kredit dalam bentuk Ijarah Muntahiyah Bittamlik dan Sale & lease back adalah suatu kondisi dimana Bank membeli aset dari Debitur (obyek IMBT sudah atas nama debitur). Bank selanjutnya secara prinsip menjadi pemilik aset tersebut kemudian menyewakan obyek Ijarah Muntahiyah Bittamlik tersebut kepada debitur hingga akhir masa sewa (jangka waktu fasilitas kredit). Penerapan Obyek Ijarah Muntahiyah Bittamlik dan sale & lease Back di Bank menimbulkan perbedaan pendapat dalam hal Obyek Ijarah Muntahiyah bit tamlik dan Agunan yang diberikan merupakan tanah dan bangunan yang sama. Akibatnya Subjek Hukum pada perjanjian pokok dan perjanjian accesoir terkesan bertolak belakang atau berlawanan. Pada Akta Pemberian Hak Tanggungan (APHT) yang dibuat oleh Pejabat Pembuat Akta Tanah (PPAT), obyek Ijarah muntahiyah bittamlik yang secara prinsip adalah milik Bank sehingga dapat disewakan Bank kepada debitur, tetapi juga dipasang Hak tanggungan sebagai jaminan atas kredit tersebut. Dalam penelitian ini, tipe penelitian yang digunakan adalah penelitian hukum normatif terhadap azas-azas hukum dengan pengumpulan data melalui studi kepustakaan, naskah akademis, jurnal hukum dan informasi di internet untuk kemudian diolah dengan metode kwalitatif, sehingga hasil penelitian yang diperoleh Pengikatan jaminan kredit Ijarah Muntahiyah bittamlik merupakan accesoir dari pengikatan pokoknya yaitu Perjanjian kredit Ijarah muntahiyah bittamlik & sale and lease back. Oleh sebab itu seharusnya ada keselarasan subjek hukum pada kedua nya. Temuan hukum terjadi pada proses pengikatan jaminan, dimana terjadi penempatan subjek hukum yang tumpang tindih antara perjanjian pokok dengan APHT (pengikatan jaminan). Bahwa terkait hal tersebut, sebaiknya untuk perjanjian kredit ijarah muntahiyah bittamlik disyaratkan bahwa antara obyek Ijarah muntahiyah bittamlik dengan agunan/jaminan harus barang yang berbeda / The credit agreement in the form of Ijarah Muntahiyah bittamlik and sale & lease back is a condition in which the Bank busy the assets of the debtor. The Bank subsequently in principle become the owner of the asset, then leases the Ijarah Muntahiyah bittamlik object to the debtor until the end of the lease period( term of credit facillity). Implementation of Ijarah muntahiyah bittamlik and sale & lease back at the Bank creates a difference of opinion in the case of Ijarah muntahiyah bittamlik’s object and the collateral provided is the same land and building. Consequently the legal subject to the principal agreement and the accessoir agreement seems contradictory. On the Deed of assignment rights made by the Land deed authority, the Ijarah muntahiyah bittamlik’s object is principally owned by the Bank so that it can be leased the Bank to the debtor, but also placed the mortgage as collateral for the credit. In this study, the type of research used is normative legal research on the principle of law with data collection through literature studies, academic texts, journals law,and information on the internet, to then processed with qualitative methods, so that the result of the research obtained the binding of ijarah muntahiyah bittamlik credit collateral is the accessoir of the principal agreement of credit agreement. Therefore there should be harmony of the legal subject in both. The legal findings occur in he guarantee binding process, whereby the placement of legal subject overlaps the principal agreement with the binding of the collateral (APHT). Whereas in relation to the findings of the law, it is recommended that an Ijarah muntahiyah bittamlik credit agreement be required that between Ijarah muntahiyah bittamlik objects and collateral should be different items
