Abstract

In order to afford a house, a buyer may place an order and pay a sum of money to the seller, however, the house itself has not been physically built. Once the order placed, the buyer and seller will later enter into and bind themselves onto a Conditional Sales and Purchase Agreement (CSPA). This thesis was focused on the subject matter of the legal standing of privately drawn-up Conditional Sales and Purchase Agreement as the fundamental evidence for the application of land ownership at Land Registry Office of the Administrative City of Jakarta Barat and the issues arising from the application of land certificate over the land which is partly owned by the bankrupt developer. This research was normative juridical study which engaged the literature data, laws and regulations, case approach and conceptual approach during the study. The research revealed that privately drawnup Conditional Sales and Purchase Agreement can be used as the fundamental evidence in proofing the legal correlation between the applicant and the land upon which ownership application was filed, as such land is classified as the eigendom land. During the bankruptcy proceeding, and the privately drawn up CSPA explains that there is no land ownership conveyance, hence, such land remains legally under the ownership of developer. The curator may file and record such land into the insolvency asset list for the purpose of liquidation to the insolvency object. / Untuk memiliki sebuah rumah, pembeli dapat melakukan pemesanan dan membayar sejumlah uang kepada penjual, walaupun bangunan rumah belum ada secara fisik. Setelah dilakukan pemesanan, pembeli dan penjual kemudian mengikatkan diri dengan membuat Perjanjian Pengikatan Jual Beli (PPJB). Pokok permasalahan dalam tesis ini adalah bagaimana kedudukan hukum Perjanjian Pengikatan Jual Beli lunas dibawah tangan sebagai alas hak untuk permohonan hak di Kantor Pertanahan Jakarta Barat dan problematika dari permohonan sertipikat hak atas tanah yang tanahnya merupakan bagian dari harta pengembang yang pailit. Penelitian ini adalah penelitian yuridis normatif yang menggunakan data kepustakaan, peraturan perundang-undangan, pendekatan kasus dan konseptual dalam penelitian. Hasil dari penelitian ini adalah PPJB lunas bawah tangan dapat dijadikan sebagai alas hak untuk melakukan permohonan hak di kantor pertanahan, sepanjang PPJB lunas bawah tangan tersebut dapat membuktikan adanya hubungan hukum antara pemohon dengan tanah yang dimohon oleh karena termasuk ke dalam jenis tanah negara bekas hak atas tanah. Pada proses kepailitan, pada PPJB lunas bawah tangan, belum terjadinya pengalihan hak kepemilikan, maka tanah tersebut secara hukum masih menjadi milik Pengembang. Kurator dapat memasukkan dan mencatat tanah tersebut dalam daftar harta pailit untuk dilakukan pemberesan terhadap harta pailit.
