Abstract

Notary is a public official who is authorized to make authentic deeds and has other authorities as stated in Article 15 paragraph (1) of Law Number 2 Year 2014 concerning Amendments to Law Number 30 Year 2004 concerning Notary Position that the Notary has the authority to make authentic deeds concerning all deeds, agreements, and stipulations required by the laws and / or those desired by those concerned to be stated in the authentic deed, guaranteeing the date of making the deed, storing the deed, giving the grosse, copy and quotation of the deed, all during the deed making it is not also assigned or excluded to other officials or other people as stipulated by law. The Agreement on Bonds for Sale and Purchase (PPJB) is one of the legal products or forms of authentic deeds made by Notaries, PPJB is the initial bond between the seller and the buyer of land whose contents are based on the agreement of the parties. In this study, data collection was carried out using a normative juridical approach, namely research carried out on written and unwritten positive law through legislation and the principles of positive law using secondary legal material in the form of the Civil Code, Invite Law Number 30 Year 2004 concerning Notary Position, Law Number 2 Year 2014 concerning Amendment to Notary Position Law, Minister of Law and Human Rights Regulation Number 61 Year 2016 concerning Procedures for Imposing Administrative Sanctions against Notaries, and Decision of the Regional Supervisory Board Notary Number 02 / Pts / Mj.PWN Prov DKI Jakarta / VII / 2012. From the results of the study, it can be concluded that the role of the Notary Regional Supervisory Board in supervising the implementation of the Notary's job duties is related to the replacement of the contents of the PPJB deed by a Notary and sanctions for the Notary who changes the contents of the PPJB deed without the knowledge of either party. / Notaris ialah pejabat umum yang berwenang untuk membuat akta autentik dan memiliki kewenangan lainnya sebagaimana dinyatakan dalam Pasal 15 ayat (1) Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris bahwa Notaris berwenang membuat akta autentik mengenai semua perbuatan, peijanjian, dan penetapan yang diharuskan oleh peraturan perundang-undangan dan/atau yang dikehendaki oleh yang berkepentingan untuk dinyatakan dalam akta autentik, menjamin kepastian tanggal pembuatan akta, menyimpan akta, memberikan grosse, salinan dan kutipan akta, semuanya itu sepanjang pembuatan akta itu tidak juga ditugaskan atau dikecualikan kepada pejabat lain atau orang lain yang ditetapkan oleh undang-undang. Peijanjian Pengikatan Jual Beli (PPJB) merupakan salah satu produk hukum atau bentuk akta autentik yang dibuat oleh Notaris, PPJB merupakan ikatan awal antara penjual dan pembeli tanah yang isinya berdasarkan kesepakatan para pihak. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan metode pendekatan yuridis normatif, yaitu penelitian yang dilakukan terhadap hukum positif tertulis maupun tidak tertulis melalui perundang-undangan dan asas-asas hukum positif dengan menggunakan bahan hukum sekunder berupa Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris, Undang-Undang Nomor 2 Tahun 2014 tetang Perubahan atas Undang-Undang Jabatan Notaris, Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 61 Tahun 2016 tentang Tata Cara Penjatuhan Sanksi Administratif terhadap Notaris, serta Putusan Majelis Pengawas Wilayah Notaris Nomor 02/Pts/Mj.PWN Prov DKI Jakarta/VII/2012. Dari hasil penelitian tersebut dapat disimpulkan bahwa peran Majelis Pengawas Wilayah Notaris dalam melakukan pengawasan terhadap pelaksanaan tugas jabatan Notaris berkaitan dengan penggantian isi akta PPJB oleh Notaris dan sanksi bagi Notaris yang melakukan perubahan isi akta PPJB tanpa sepengetahuan salah satu pihak.
