Abstract

The human rights are the most basic rights that a human can have. Unfortunately, human rights are still often violated. One form of violation against human rights is gender based rights, in the form of discrimination against women. Hence, this thesis titled “Analysis of Discrimination Against Women in Work Environment Based on the Legislative Regulations” is written. The purpose of this thesis is to analyze the government’s efforts to protect female workers’ rights against discrimination. The government has made efforts to protect the human rights of female workers from acts of discrimination and create justice in the work environment. Efforts that has been made by the governments are based on the government’s function as law maker and executor. The government’s function as law executor can be divided into two, which are super visioning and taking action. This research was conducted using statute approach and conceptual approach. Research made by the author showed that despite the efforts the government has made, there are still discrimination against women in work environment to be found. In making the law, the government must hold the principle that has been appealed in the Convention on the Elimination of All Forms of Discrimination Against Women or usually abbreviated as CEDAW, namely the substantive model approach as well as the non-discrimination approach. In addition, the government should make laws that emphasize female perspective, starting with analyzing discriminatory regulations in social practices, including law and regulations that can potentially prejudice women both in the short and long term.
