Abstract

The important purpose of land registration is to provide legal certainty as stated in Article 19 paragraph (1) and paragraph (2) of the UUPA, in which to ensure legal certainty. However, in reality, land registration does not provide legal certainty for land owners. In this study, the Author analyzed one problem through the decision in the Case Register No. 60/PDT/2005/PT. Bdg which is related to the overlapping certificate of land rights, as in the land case objects of 4 (four) fields of HGB Certificates located in Cirebon Regency. The aim of this research is to find out the legal strength of the certificate of land rights whose land overlaps with the certificate of the rights of other parties over the same land in the Case Register No. 60 / PDT / 2005 / PT. Bdg and to know the responsibility of Cirebon Regency Land Office after decision in resolving the overlapping certificate cases listed in the case. To achieve this goal, this study was compiled using a type of normative juridical research. In analyzing, the author uses 3 (three) approaches which are conceptual approach, case approach and conceptual approach. There has been found a mis-implementation of the law carried out by the Cirebon Regency Land Office and legal judgments and judgments in resolving overlapping certificates listed in the Case Register No. 60/PDT/2005/PT. Bdg is already in accordance with the applicable laws and regulations by declaring the cancellation of the certificate of land rights owned by Irwan Effendi (Defendant II). Suggestions in this study are (1) land registration should be carried out by the Cirebon Regency Land Office carefully, so that the data presented as far as possible can be accounted for. (2) Should be fully responsible for cases of overlapping land rights in Cirebon Regency is the Cirebon Regency Land Office (Defendant II).
