Abstract

Pemindahan hak atas tanah adalah perbuatan hukum untuk memindahkan hak atas tanah kepada pihak lain. Pemindahan dilakukan apabila status hukum pihak yang akan menguasai tanah memenuhi persyaratan sebagai pemegang hak atas tanah yang tersedia, dan pemegang hak atas tanah tersebut bersedia untuk memindahkan haknya. Dalam perolehan tanah melalui perbuatan hukum adalah suatu perbuatan hukum pemindahan hak yang bertujuan untuk memindahkan sebidang tanah hak kepada pihak lain yang memenuhi syarat tersebut dan wajib dilakukan dihadapan Notaris/PPAT dan dengan prinsip itikad baik melakukan permohonan dan membuat akta pemindahan hak karena tanah tersebut telah beralih dan menjadi tanah negara. Tanah beralaskan Eigendom Verponding tetap dapat dialihkan, karena walaupun sudah menjadi tanah negara tetapi tidak menghilangkan unsur keperdataan dari tanah tersebut. Dengan dibuat akta notaris kemudian baru dapat dimohonkan sertipikatnya, apabila terdapat sertipikat kepemilikan pihak lain maka terjadi sengketa dan pihak lain itu harus dapat membuktikan bukti dan dasar kepemilikan hak atas tanah tersebut. Pemindahan hak hanya dapat didaftarkan jika dibuktikan dengan akta Notaris/PPAT. Dengan adanya akta tersebut yang juga menjadi syarat bagi pendaftaran pemindahan haknya, dan yang membuat akta pemindahan haknya sebagai bukti syarat terjadinya dan sahnya suatu perbuatan hukum dalam pemindahan hak yang dilakukan. Fungsi Notaris/PPAT adalah sebagai pejabat yang berwenang dalam membuat akta dan sebagai saksi bahwa benar telah dilakukannya suatu perbuatan hukum yang bersangkutan, dan sebagai pembuktian telah berpindahnya hak atas tanah yang bersangkutan kepada penerima hak. Setelah proses permohonan pemindahan hak telah selesai kemudian oleh BPN dapat dilakukan pengukuran, pemetaan, dan pendaftaran, kemudian baru dapat dikeluarkan buku tanah serta sertipikat, sebagai alat pembuktian yang kuat, berupa sertifikat hak atas nama penerima hak / In the acquisition of land through legal action is a legal act of transfer of rights that aims to move a plot of land rights to other parties who meet the requirements and must be done by Notary / PPAT and by the principle of good faith , to make a deed of transfer of rights because the land has been transferred and become state land. The transfer is made when the legal status of the parties will dominate the land and meet the requirements of the holders of the land through a legal act, and was an act of legas transfer of rights is intended to transfer the land rights to another party that meet the mandatory requirements and performed in front of notary/PPAT and make Act the transfer of rights because the land has transferred and became state land. A land with evidence Eigendom Verponding can be still diverted because it has become a state land but does not eliminate the civil element of the land. By notarial deed is made then can be applied for the certificate, if there is a certificate of ownership of another party then there is a dispute and the other party must be able to prove the evidence and base of ownership of the land rights. The transfer of rights can only be registered if it is proved with a notary/PPAT act. The existence of such deed is also a requirement for the registration of the transfer of their rights, and which makes the deed of transfer of their rights as proof of the condition of the occurrence and validity of a legal act in the transfer of rights done. The function of Notary / PPAT is as evidence that the legal act has been done, and as a proof of the transfer of rights to the land concerned to the recipient of the right. After the process of requesting the transfer of rights has been completed then by the BPN can be measured, mapping, and registration, then can be issued a book of land and certificate, as a powerful evidentiary tool, a certificate of rights on behalf of the recipient of rights
