Abstract

Responding to increase financing needs and other financial services in Indonesia, there are developments in the financial industry sector, which is popularly referred to as financial technology or abbreviated as Fintech. One of the most popular types of Fintech in Indonesia is crowdfunding or Peer-to-Peer (P2P) -based loans, which offer the convenience of lending-buying money using online platforms. With the introduction of loan-based crowdfunding, not only the benefits that we need to consider, but we also need to be aware of developments and risks that can harm consumers. Therefore, normative research was conducted to see which legal protection for P2P lending consumers use with regulations in Malaysia and English that were previously issued. Based on the results of research that analyzed and compared the Financial Services Authority Regulation No. 77 / POJK.01 / 2016 concerning Information Technology-Based Money Lending and Borrowing Services with Securities Commission Guidelines on Regulated Market and Crowdfunding and Promotion of Security Instruments and the Promotion of Non-Readily Realisable Securities Instrument in 2014 by Financial Conduct Authority. All countries regulate the matters similarly how to regulate between Indonesia, Malaysia and the United Kingdom. It can be concluded from Indonesia that it has been adequate legal protection for consumers to mitigate risk, but there are still some important points that can be learned from arrangements in Malaysia and the UK, such as financial services supervisory bodies, information disclosure and complaints mitigating the risk of failing to pay and protect interests general.
