Abstract

Notaris merupakan satu-satunya pihak yang diberikan kewenangan dalam mengakses Sistem Administrasi Badan Hukum(SABH). Peranan Notaris dalam kewajibannya menjalankan amanah dari pemberi kuasa, untuk melaporkan perubahan data perseroan pada Kementerian dengan dasar akta Notaris yang dibuat oleh Notaris tersebut. Apabila terjadi kesalahan dalam pengisian data tersebut, akan memberikan konsekuensi hukum dan pertanggungjawaban Notaris sebagai pihak yang melakukan pengisian pada format isian Perubahan Data Perseroan di SABH. Konsekuensi dari kesalahan tersebut, pihak perseroan atau pihak yang menderita kerugian dapat menuntut penggantian biaya dan ganti rugi kepada Notaris. Untuk memperbaiki kesalahan tersebut Notaris dapat memperbaikinya dengan mengirimkan surat permohonan dan surat pernyataan kepada Kementerian untuk melakukan perbaikan database pada SABH. Tesis ini menggunakan metode penelitian normatif dengan cara pendekatan perundang-undangan dan pendekatan kasus /Notary is the only party granted authority in accessing Sistem Administrasi Badan Hukum (SABH). The role of a Notary in his obligation to perform the mandate of the authorized person, to report changes in the company's data to the Ministry on the basis of the Notarial Deed made by the Notary. In the event of errors in the filling of such data, will provide legal consequences and liability of Notary as the party who fills in the format of Data Changes of the Company in SABH. Consequences of such mistakes, the company or the party suffering losses may demand reimbursement of costs and redress to the Notary. To correct the error, the Notary may correct it by sending a letter of application and a letter of statement to the Ministry to repair the database on SABH. This thesis uses normative research method by approach of legislation and case approach
