Abstract

Pasar modal sebagai salah satu sektor jasa keuangan hari ini telah berkembang pesat yang memiliki dampak pada kemajuan ekonomi negara tersebut. Menjalankan transaksi dan tindakan di pasar modal membutuhkan peran serta dukungan dari profesi penunjang pasar modal sebgaimana tertuang dalam Undang-Undang Nomor 8 Tahun 1995 tentang Pasar Modal. Untuk melakukan fungsinya sebagai notaris mematuhi Undang-Undang Nomor 2 Tahun 2014 tentang Peraturan Jabatan Notaris di samping harus mematuhi aturan yang telah ditetapkan oleh undang-undang dalam lingkup pasar modal. Salah satu aturan adalah Peraturan Pemerintah Nomor 11 Tahun 2014 tentang pungutan oleh Otoritas Jasa Keuangan (OJK) sebagai salah satu lembaga yang berwenang untuk mengatur regulasi dan fungsi pengawasan sebagai salah satu sektor jasa keuangan yang melakukan kegiatannya melakukan pungutan terhadap profesi penunjang pasar modal diantaranya adalah notaris, termasuk notaris. Tulisan ini meneliti posisi notaris dalam pasar modal sebagai profesi penunjang berdasarkan Peraturan Kantor Notaris dan kewenangan OJK untuk mengumpulkan pungutan dari Peraturan Keuangan Negara perspektif. Penelitian ini merupakan penelitian yuridis normatif, dengan menggunakan Peraturan Jabatan Notaris, Peraturan Otoritas Jasa Keuangan, Peraturan Pasar Modal, Peraturan Menteri Keuangan dan Peraturan Pemerintah Pungutan oleh Notaris Jasa Keuangan. Hasil analisis mengatakan bahwa profesi penunjang pasar modal termasuk notaris termasuk sebagai pihak yang dapat dikenakan untuk membayar pungutan oleh Otoritas Jasa Keuangan (OJK) sebagaimana termuat dalam PP no 11 tahun 2014 dan dikuatkan dalam putusan Mahakamah Agung Nomor 69 P/HUM/2014 Kewenangan OJK untuk melakukan pungutan kepada profesi penunjang pasar modal yang tepat seperti apa yang telah dikondisikan oleh Peraturan Keuangan Negara. Hal ini menilai bahwa OJK dikenal sebagai pengelola dan mengatur pendapatan yang berasal dari mereka pungutan secara independen / The capital market as one of the financial service sectors today has grown rapidly which has an impact on the country’s economic progress. Doing transactions and actions in the Capital Market requires the participation of the capital market supporting profession as stipulated in Law Number 8 of 1995 concerning the Capital Market. To perform its functions, a notary obeys Law Number 2 Year 2014 on Notary Position Regulation in addition to comply with the rules established by law in the Capital Market scope. One of the rules is Government Regulation Number 11 Year 2014 concerning charges by the Financial Services Authority (FSA) as one of the institutions authorized to regulate the regulation and supervisory function as one of the financial service sectors that charges the capital market supporting profession such as notary, including notaries. This paper examines the position of notary in the capital market as a supporting profession under the Regulation of Notary Office and the authority of FSA to collect charges from the perspective of State Financial Regulation. This research is a normative juridical research, using Notary Position Regulation, Regulation of Financial Service Authority, Capital Market Regulation, Minister of Finance Regulation and Government Regulation of Charges by Notary of Financial Services. The results of the analysis indicate that the capital market supporting profession including notary is included as a party that can be imposed to pay charges by the Financial Services Authority (FSA) as contained in Government Regulation no. 11 of 2014 and reinforced in Supreme Court Decision Number 69 P / HUM / 2014 the authority of FSA to impose charges on the right capital market supporting profession as conditioned by the State Finance Regulation. It is considered that FSA is known as a manager and regulates revenues from independent charges
