Abstract

With the existence of globalization, there is a large increase in trademark registration and the development regulations in Indonesia have become one of the top priorities. Various regulations and regulations issued by the government to tighten brand users and reduce expenditure for brand owners, one of which is Law No. 20 of 2016 concerning Trademarks and Geographical Indications that have been published and updated allow regulatory reforms that are less effective in the previous legislation. The new law can be an Indonesian trademark known by the public and active in the market. However, well-known marks must also be protected in the international market and system. Registration through Madrid Protocol is approved by international marks. Madrid Protocol's effectiveness can be carried out further through various research methods such as online research, research of books and journals, interviews, and even data analysis in surveys. This makes it possible to discuss whether the method applied to protect the internationally proposed brand is because the trademark registration system in Indonesia is not perfect and in electronic data conversion. The skills of the workers in English can also be a problem because all submissions through the Madrid Protocol use one language. Both of these can be sources of problems in the enforcement of the Madrid Protocol and can be considered ineffective. However, after conducting research, workers will increase the difficulty in registering brands. The Enforcement of Madrid Protocol also supports their mark owners not need to wait a long time for their brands to be registered in several countries and is also a source of various resources that help understand the English needed to register. However, not all brand owners will know the Madrid Protocol. This can be done through positive advertisements carried out by the government and also promotions and seminars to socialize the registration of brands and the Madrid Protocol to the people of Indonesia.
