Abstract

This thesis researches about the regulatory challenges in governing consumer protection in information technology-based lending service or peer-topeer lending. The financial service authority (OJK) in regulating peer-to-peer lending encounters challenges in consumer protection from both the creditor and debtor, this includes undisclosed fees and interest, lack of transparency in the agreement, aggressive debt collection and the existence of illegal platforms. Therefore, the question arises whether the issues occur due to OJK regulations and what are the ways to resolve them. The result of the research shows that peer-topeer lending has weaker consumer protection regulations due to its categorization as ‘Other financial institution’ especially regarding transparency. Furthermore, there are many aspects that are ambiguous or contains legal vacuums, such as in the field of debt collection. This research shows that OJK has very wide authority and has the authority to amend or create new regulation in the financial service sector. Based on the research, it is recommended that OJK amends POJK No.1/POJK.7/2013 or POJK No.77/POJK.1/2016 or create a new regulation which is more comprehensive. In order to increase supervision and consumer protection it is recommended for OJK to accelerate the regulatory sandbox program by increasing the pace of registration and creating the necessary structures. / Skripsi ini mengkaji tentang tantangan perundang-undangan dalam pengaturan perlindungan konsumen dalam layanan pinjam-meminjam berbasis teknologi informasi atau peer-to-peer lending. OJK dalam mengatur peer-to-peer lending memiliki tantangan perlindungan konsumen baik dari pihak kreditur maupun debitur, antaranya penyingkapan biaya dan bunga, kurangnya transparansi dalam perjanjian, penagihan hutang yang aggresif dan keberadaan platform ilegal. Maka timbullah pertanyaan apakah permasalahan timbul dari peraturan OJK dan bagaimanakah cara mengatasinya. Hasil penelitian menunjukan bahwa peer-topeer lending mempunyai peraturan perlindungan konsumen yang lebih lemah karena kategorinya sebagai ‘lembaga jasa keuangan lainnya’ terutama dalam bidang transparansi. Selain itu, masih banyak aspek yang mempunyai ketidakjelasan atau kekosongan hukum seperti dalam bidang debt collection. Penelitian menunjukan bahwa OJK mempunyai kewenangan yang luas dan dapat mengubah dan membuat peraturan sektor jasa keuangan. Berdasarkan penelitian ini, disarankan OJK mengamandemen POJK No.1/POJK.7/2013 atau POJK No.77/POJK.1/2016 atau membuat peraturan baru yang lebih komprehensif. Untuk meningkatkan pengawasan dan perlindungan konsumen, disarankan juga agar OJK mempercepat program regulatory sandbox dengan memajukan pendaftaran dan membina sarana yang diperlukan.
