Abstract

As reflected in their constitutions, the political constellation in modernized states have shifted to bestow more weight to godly values. In line with this trend, both Indonesia’s constitution as well as the Pancasila demonstrate that religious values have become very intertwined with the ways of life of its society. By regulating religious values in its constitution, Indonesia highlights that the constitution should become one of the determinative essence of a state’s national identity, as opposed to merely being a formal text deprived of any soul. On the other hand, the diversity of religious beliefs in Indonesia so often triggers divisive political instability, during which religions are ironically exploited to justify the selfish interest of each. Such phenomenon is not at all exclusive to Indonesia, but is a widespread dilemma in nearly all democratic society worldwide. In light of the aforementioned, the author seeks to propose an innovative way to best regulate religious values in Indonesia’s constitution, by drawing comparison with how religion is regulated in 60 other constitutions globally. The author is particularly inclined to compare the distinction between how religious values are regulated in the 50 most religiously-diverse and 10 least religiously-diverse countries worldwide. By using religion fractionalization by Alesina et al. as a parameter to assess those 60 constitutions, this research relies on comparative, statutory, and historical approach. Bearing in mind that our society is deep-rooted in spiritual values, it is the author’s position that an innovative way to regulate religious values in Indonesia’s constitution is of utmost importance. The purpose of such is to accommodate both societal recognition and distribution, all in the hope of preventing unnecessary clashes in the coming days.
