Abstract

Pasal 20 Undang-Undang Jabatan Notaris No. 2 Tahun 2014 mengatur tentang diperbolehkannya Notaris berkumpul dalam suatu persekutuan perdata, dalam arti adalah kantor bersama Notaris. Persekutuan perdata bagi Notaris yang dimaksud dalam Undang-Undang Jabatan Notaris bertolak belakang dengan prinsip-prinsip persekutuan dalam KUH Perdata. Menurut KUH Perdata, persekutuan adalah suatu perjanjian antara dua orang atau lebih yang mengikatkan diri dengan cara memasukkan sesuatu kedalam persekutuan, dengan maksud untuk membagi keuntungan darinya.Tujuan penelitian hukum ini secara umum adalah untuk mengetahui efektifitas pelaksanaan Pasal 20 UUJN No. 2 Tahun 2014 mengenai persekutuan perdata bagi Notaris. Secara khusus adalah untuk menganalisis dan mengevaluasi mengenai manfaat dan efektifitas pelaksanaan Pasal 20 UUJN No. 2 Tahun 2014, sejauh mana tanggung jawab Notaris dalam suatu persekutuan perdata setelah dihapusnya ketentuan pasal 20 ayat (3) UUJN No. 30 Tahun 2004, dan kemungkinan adanya pembagian keuntungan sebagaimana tujuan persekutuan perdata yang diatur dalam KUH Perdata. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif yang dilakukan melalui pengumpulan data dengan menggunakan pendekatan perundang-undangan dan juga pendekatan konseptual. Berdasarkan hasil penelitian, dapat disimpulkan bahwa manfaat dan efektifitas pelaksanaan Pasal 20 UUJN mengenai persekutuan perdata bagi Notaris adalah tidak efektif karena kemanfaatannya hanya kantor bersama untuk efisiensi biaya-biaya kantor. Dampak negatif bagi Notaris dalam persekutuan perdata, antara lain Notaris tidak dapat menjaga kemandiriannya dan ketidakberpihakan dalam suatu persekutuan karena adanya tanggungjawab renteng, kerahasiaan akta menjadi terbuka, benturan kepentingan akibat pemasukan yang disetor, persekutuan perdata dapat digunakan untuk memperkaya diantara sekutunya, Notaris yang telah pensiun dapat ikut dalam kantor bersama secara terselubung, sanksi bagi Notaris yang melanggar UUJN dan Kode Etik. Tanggung jawab Notaris dalam suatu persekutuan perdata setelah dihapusnya ketentuan Pasal 20 ayat (3) UUJN Nomor 30 tahun 2004 adalah tidak berpengaruh apapun, dikarenakan Notaris mempunyai kewenangan dan tanggung jawab yang melekat (atributif) pada jabatan seorang Notaris. Maka, mengenai tanggung jawabnya Notaris harus tunduk pada ketentuan yang telah diatur dalam UUJN. Pelaksanaan pembagian keuntungan dalam suatu persekutuan perdata Notaris yang tunduk pada ketentuan KUH Perdata tidak mungkin dilakukan karena bertentangan dengan UUJN. Notaris melakukan pelayanan kepada masyarakat tidak mempunyai tujuan mencari keuntungan. Pasal 36 UUJN mengatur Notaris hanya boleh menerima honorarium atas jasa hukum yang diberikan sesuai kewenangannya / Article 20 of Law on Notary Position No. 2 of 2014 regulates the permissibility of Notary to gather in a civil partnership, in a sense is a shared office of Notary. Civil Partnership for Notary referred to in Law of Notary Position is contrary to the principles of partnership in the Civil Code. According to the Civil Code, a partnership is an agreement between two or more people that bind themselves by way of entering something into the partnership, with the intention to share profits.The law research objective in general is to know the effectiveness of the implementation of Article 20 Law on Notary Position No. 2 2014 regarding a civil partnership for Notaries. In particular it is to analyze and evaluate the benefits and effectiveness of the implementation of Article 20 Law on Notary Position No. 2 In 2014, the extent of responsibility of the Notary in a civil partnership after the abolition of the provisions of Article 20 (3) Law on Notary Position No. 30, 2004, and the possibility of profit sharing as a civil partnership objectives set out in the Civil Code. The method used in this study is a normative legal research method conducted through data collection using the approach of legislation and conceptual approache. Based on the results of the research, it can be concluded that the benefits and effectiveness of the implementation of article 20 Law on Notary Position about civil partnership for Notaries are ineffective because it benefits only the shared office for efficiency costs of the Office. The negative impact to the notary in the Civil Partnership, among others, a notary cannot maintain his independence and impartiality because of the share responsibility, confidentiality deed becomes open, a conflict of interest due to the revenue, Civil partnership can be used to enrich among allies, retired Notary may participate in a shared Office in veiled, sanctions for notary public who violate the code of ethics and Law on Notary Position. Notary responsibility in a civil partnership after the abolition of the provisions of Article 20 (3) Law on Notary Position No. 30 of 2004 is not affecting whatsoever because Notary shall be subject to the provisions set out in Law on Notary Position and the Civil Code. The distribution of profits in a civil partnership of Notary should be subject to the provisions of the Civil Code. The distribution according to the amount of income entered by their respective partners. This is contrary to Law on Notary Position because Notaries perform the public service does not have a purpose for profit
