Abstract

Notaris memempunyai peranan yang penting di masyarakat khususnya di bidang bisnis. Akta yang dibuat oleh atau di hadapan Notaris merupakan akta autentik dan memiliki kekuatan pembuktian yang sempurna bagi para pihak. Notaris dalam melaksanakan jabatannya selain membuat akta, juga menerima protokol dari Notaris yang sudah tidak lagi menjabat dikarenakan meninggal, berhenti, diberhentikan sementara atau diberhentikan secara tidak hormat. Protokol Notaris adalah kumpulan dokumen yang merupakan arsip negara yang harus disimpan dan dipelihara oleh Notaris sesuai dengan ketentuan peraturan perundang-undangan. Tujuan penelitian untuk menganalisis perlindungan hukum bagi Notaris selaku pemegang protokol yang di dalam protokolnya terdapat sengeketa dan menganalisis sejauh mana tanggung jawab Notaris terhadap protokol Notaris lain. Metode penelitian yang digunakan adalah metode penelitian hukum normatif yaitu metode penelitian hukum yang objeknya merupakan norma hukum dengan tujuan menguji kualitas dari norma hukum yang merupakan objek penelitian dengan mendasarkan pada unsur esensial serta tujuan utama dari hukum yaitu keadilan, kemanfaatan dan kepastian. Hasil penelitian penulisan ini adalah perlindungan hukum bagi Notaris pemegang protokol belum diatur secara jelas dalam UUJN. UUJN hanya mengatur mengenai prosedur Notaris sebagai pemegang protokol jika dipanggil oleh pihak penyidik. Notaris pemegang protokol tidak bertanggung jawab terhadap protokol Notaris lain, tetapi Notaris pemegang protokol hanya berwenang mengeluarkan Grosse Akta, Salinan Akta, atau Kutipan Akta. Notaris, Notaris Pengganti, dan Pejabat Sementara Notaris bertanggung jawab atas setiap akta yang dibuatnya meskipun Protokol Notaris telah diserahkan atau dipindahkan kepada pihak penyimpan Protokol Notaris / Notary has an important role in society, especially in business industry. Deed that made by or in front of the Notary is an authentic deed and has a perfect power of proof for the parties. Aside on performing the duties on making deed, Notary also receive a protocol from the Notary that no longer served due to death, quit, temporary terminated or dismissed in disrespect. Protocol Notary is a collection of documents that is country achieves that must be keep and maintain by Notary accordance with the regulation legislative. The purpose of the research is to analyze the law protection for the Notary as the protocol holder, which there is a dispute inside and to analyze the extent of responsibility notary to other protocol notary. The research methodology that been used was research legal normative; which was methodology law where the object was legal norm in purpose to test the quality of the legal norm, which are a research object based on essential element, as well as the objective from law are justice, expedience, and certainty. The conclusion of this research is the legal protection for the Notary who holds the protocol has not been clearly regulated in UUJN. UUJN only managed about the procedure of the notary as the protocol holder if the investigators called them. Notary who holds the protocol is not responsible to other Notary protocol, but the holder only authorized to issued groose deed, copy, or quote deed. Notary, substitute Notary, and temporary Notary are responsible on every deed that they made, even though protocol Notary has been given over or transferred to the parties that keep the protocol
