Abstract

Notaris ialah pejabat umum yang memiliki wewenang untuk membuat akta otentik dan kewenangan lainnya sebagaimana dimaksud dalam pasal 1 angka (1) Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris. Metode penelitian yang digunakan penulis ialah metode penelitian hukum normatif. Tujuan penelitian ini untuk menganalisis tentang tanggung jawab Notaris pengganti dan solusi hukum terhadap akta yang dibuat olehnya. Jika melihat penjelasan dan menganalisis dari beberapa pasal mengenai Notaris pengganti, Pasal yang menjelaskanya antara lain pasal 33, mengenai hal ini Notaris, Notaris pengganti memiliki kewenangan yang sama terkait pembuatan akta otentik yang dibuat olehnya. Di sisi lain dalam pasal 65, Notaris, Notaris pengganti memiliki tanggung jawab yang sama dalam pembuatan akta otentik dengan Notaris. Sebaiknya harus ada aturan tersendiri mengenai kewenangan dan tanggung jawab Notaris pengganti. Harus ada penambahan syarat dan pembatasan kewenangan terhadap Notaris pengganti / Notary is a public official who has the authority to make authentic act and other authorities referred to in Article 1 paragraph (1) of the Constitution of the Republic of Indonesia Number 2 Year 2014 on the Amendment to Law Number 30 Year 2004 on Notary. The method used is the author of normative legal research methods. The purpose of this study to analyze the responsibility of substitute Notary and legal remedies against the deed made by him. If you see a description and analysis of some of the provisions of the Notary substitute, chapter menjelaskanya include article 33, regarding this Notary, the Notary substitute has the same authority related to the manufacture of authentic deed made by him. On the other hand in chapter 65, the Notary, the Notary substitute has the same responsibility in making authentic deed with the Notary. We recommend that there should be separate rules regarding the authority and responsibility of substitute Notary. Must be additional terms and restrictions on the authority of the Notary substitute
