Abstract

Bank syariah menyediakan pembiayaan KPR (Kepemilikan Pembiayaan Rumah) Syariah berbasis murabahah. Akta pengakuan utang yang dibuat oleh notaris mempunyai peranan yang sangat penting dalam akad murabahah ini. Penelitian penulisan tesis ini didasarkan pada penelitian normatif, yaitu penelitian yang dilakukan untuk mengkaji peraturan perundangan-undangan yang berlaku dan sifatnya yang normatif. Tipe penelitian yang dipergunakan dalam penyusunan buku ini adalah yuridis normatif, artinya permasalahan yang diangkat, di bahas dan diuraikan dalam penelitian untuk penulis antesis ini di fokuskan dengan penerapan kaidah-kaidah atau norma-norma dalam hukum positif. Akta Pengakuan Utang adalah suatu akta yang berisi mengenai pengakuan utang sepihak, dimana Debitur mengakui bahwa dirinya mempunyai kewajiban membayar kepada Kreditur sejumlah uang dengan jumlah yang pasti (tetap). Dalam paket pemberian pembiayaan bank syariah Akta Pengakuan Utang ini selalu diikut sertakan, terlebih yang bersifat jual beli KPR yang menggunakan akad Murabahah. Berbicara mengenai grosse akte maka hal itu tidak bisa lepas dari akta notaris, oleh karena grosse tidak lain adalah turunan atau salinan dari akta notaris yang dibuat dalam bentuk minuta dan disimpan dalam arsip kantor Notaris. Penelitian ini menyimpulkan bahwa grosse akta pengakuan utang yang dibuat oleh notaris berdasarkan permintaan bank-bank pemberi pembiayaan belum dapat memberikan perlindungan hukum kepada bank atas tindakan wanprestasi oleh debitur, karena di dalam grosse akta pengakuan utang tersebut masih terdapat klausula- klausula yang bersifat perjanjian yang menimbulkan akibat hukum berupa berubah status menjadi suatu akta otentik perjanjian yang tidak mempunyai kekuatan eksekutorial, sehingga eksekusinya hanya dapat dilakukan melalui gugatan perdata biasa / Islamic banks provide mortgage financing (KepemilikanPembiayaanRumah) Sharia-based murabaha. Deed of acknowledgment of debt made by notaries have a very important role in this murabahah contract. Thesis research was based on normative research, the research done to examine legislation and regulations in force and normative nature. This type of research that is used in the preparation of this book is normative, meaning that the issues raised, discussed and described in the research for this anthesis author in focus with the application of the rules or norms in the positive law. Deed of Acknowledgement of Debt is a deed which contains the unilateral debt instruments, where the Debtor admitted that he has an obligation to pay to the creditor a sum of money by a certain number (fixed). In the administration of Islamic bank financing package Promissory Notes Act is always included, in particular those that are buying and selling mortgages that use Murabahah. Talking about grosse deed then it can not be separated from the notarial deed, therefore grosse none other is an instance or a copy of a notarial deed is made in the form of the minutes and kept in the archives of the Notary office. The study concluded that grosse deed of acknowledgment of debt made by the notary upon request banks financing provider can not provide legal protection to the bank for the actions of default by the debtor, because in grosse deed of acknowledgment of debt is still there are clauses which are agreements that give rise the legal consequences in the form of changed status to become an authentic deed agreement that lacks the power eksekutorial, so that execution can only be done through the ordinary civil lawsuit
