Abstract

Bank sebagai lembaga keuangan mempunyai peran penting dalam melakukan pemberian fasilitas kredit. Pemberian fasilitas kredit ini tentunya melalui mekanisme tertentu. Pada keadaan tertentu untuk meminimalisir kerugian terhadap kredit yang diberikan, Bank mengalihkan piutangnya terhadap pihak ketiga melalui pengalihan piutang/cessie. Dalam praktek peralihan piutang terhadap pihak ketiga tidak terlepas dari peran Notaris sebagai pejabat pembuat akta otentik, akta otentik yang dibuat oleh notaris merupakan alat bukti yang kuat dan menjadi perlindungan hukum bagi Bank dan Debitur. Penelitian ini dilakukan bertujuan untuk mengetahui bagaimana pengalihan piutang/cessie kepada pihak ketiga menurut KUHPerdata dan bagaimana peran Notaris pada pelaksanaan penyelesaian kredit bermasalah dengan cessie pada PT Bank Tabungan Negara (Persero) Tbk. Dengan menggunakan metode penelitian yuridis normatif disimpulkan: bahwa Proses Pengalihan Piutang/cessie sebagaimana yang diatur dalam KUHPerdata tidak secara nyata disebutkan. Sehubungan dengan hal tersebut maka adanya suatu perjanjian tertulis, baik itu berupa akta otentik maupun akta di bawah tangan, adalah merupakan sesuatu yang mutlak untuk dipenuhi di dalam melakukan pengalihan piutang atas nama. Hal ini berdasarkan ketentuan Pasal 613 KUHPerdata. Namun, keberadaan perjanjian cessie yang dibuat baik secara otentik atau dibawah tangan itu belum akan mengikat dan atau memberikan akibat hukum apapun juga kepada debitur bilamana hal tersebut, telah dilakukannya pengalihan piutang secara cessie ini tidak diberitahukan kepada debitur atau secara tertulis tidak diakui atau disetujui debitur. PT Bank Tabungan Negara (Persero) Tbk dalam melakukan pengalihan piutang/cessie diwajibkan memberikan surat pemberitahuan akan melakukan pengalihan piutang/cessie kepada debiturnya sesuai dengan Pasal 613 KUHPerdata selain itu didukung oleh peran notaris dalam kaitannya dengan akta cessie / Bank as financial institutions has a significant role in the provision of credit with certain mechanisms that have set. In particular, circumstances to minimize losses on loans, the Bank transferred its receivable to third parties through the transfer of receivables / cessie. Notary public acts as a public officer who draw up authentic deed in the transfer of receivables to the third party, the deed made by the notary public is a strong evidence and provides legal protection for Bank and Debtors. This research aims to identify how the transfer of receivables/cessie to the third party is conducted according to the Civil Code and how a notary public performs an official act in the settlement of non-performing loans with cessie practice in PT Bank Tabungan Negara. By using normative juridical research concluded: that the process of Transfer of Receivable (cessie) as stipulated in the Civil Code does not expressly mention. In connection with the matter, the existence of a written agreement, whether it be the official act or deed under hand, is something that is absolute to be met in the transferred accounts in the name. It based on Article 613 of the Civil Code. However, the existence of the agreement cessie made neither authentic nor under the hand it will not be binding and or give legal effect whatsoever to the debtor when it has done the transfer of cessie was not notified to the debtor or in writing is not recognized or approved by the debtor. State Savings Bank (Persero) Tbk in performing cessie required to provide a letter of notification will be transferred cessie to the debtor in agreement with Article 613 of the Civil Code
