Abstract

Peer to Peer Lending is a new breakthrough in financial services in Indonesia. This service connects lenders and loan recipients through a container provided by the organizer through its platform. The development of this service began to override similar money services, except that this service was not done through online-based Information Technology. The development of the times, made the pattern of life of the people change and become different than before. This also makes people prefer peer to peer lending services, because peer to peer lending services can reach all regions that get online services in Indonesia, compared to banks that until now have not been evenly deployed in all regions in the Indonesia. Even this activity does not guarantee the perfect success of its implementation. When the recipient of the loan fails to pay, the lender gets a loss. Loan recipients are required to provide compensation in accordance with the agreement clauses with lenders while the organizers are in as per Pasal 37 POJK Nomor 77/POJK/01/2016 tentang Layanan Pinjam Meminjam Uang berbasis Teknologi Informasi which essentially states that the organizers must provide compensation to the injured party for losses incurred during the process of this service, if the organizer is proven to have committed negligence. The protection that can be given is preventive and repressive.
