Abstract

Pelaksanaannya dalam perjanjian Kredit Pemilikan Rumah (KPR) sering terdapat permasalahan antara lain: pemindahan hak atas objek KPR, yang dilakukan di bawah tangan oleh debitor kepada pihak lain sebelum KPR tersebut lunas tanpa sepengetahuan pihak bank atau alih debitur. Berdasarkan Pasal 55 ayat (2) Undang-undang Nomor 01 Tahun 2011 Tentang Perumahan dan Pemukiman yang dalam hal dilakukan pengalihan kepemilikan sebagaimana dimaksud pada ayat (1) huruf b dan huruf c, pengalihannya wajib dilaksanakan oleh lembaga yang ditunjuk atau dibentuk oleh Pemerintah atau pemerintah daerah dalam bidang perumahan dan permukiman. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan Perundang-undangan. Dari hasil penelitian tersebut dapat disimpulkan bahwa: alih debitur di dalam masyarakat dapat terjadi dengan sepengetahuan bank dan tanpa sepengetahuan bank, baik langsung melalui bank, di hadapan Notaris atau di bawah tangan yang masing-masing cara memiliki kelemahan dan kelebihan berbeda-beda. Apabila penerima pengalihan kredit yang telah beritikad baik, telah melakukan pembayaran angsuran kredit hingga lunas namun tidak dapat mengambil asli sertifikat yang ditahan bank sebagai jaminan karena dianggap tidak berwenang oleh bank (misalnya karena alih debitur tanpa sepengetahuan bank), sementara debitur lama tidak diketahui keberadaannya maka salah satu upaya hukum yang dapat dilakukan adalah dengan mengajukan permohonan kepada Pengadilan Negeri yang wilayah hukumnya mencakup keberadaan objek (rumah KPR). In this study, data collection was carried out using a statutory approach. From the results of these studies it can be concluded that: Credit transfer on society can occur whether knowing by the bank or without knowing, either by directly through a bank, before the Notary or privately drawn up which is each methods have different weaknesses and excess. If the credit assignee who has been acting in good faith, has made credit installment payments until the debt is paid off but can not take the original certificate that the bank held as collateral because the assignee deemed not authorized by the bank (example because credit transfer doing without knowing by the bank), while the existence of the old debtor does not known, so one of the action can be done is by submit petition to the District Court whose jurisdiction includes the existence of object (house of KPR). It is better if the credit transfer only committed if the debtor made wanprestasi so it does not use as specification
