Abstract

Indonesia menjadi negara transit bagi para pengungsi dan pencari suaka sebagai persinggahan terakhir dalam perjalanan menuju negara tujuan, Australia. Meskipun Indonesia belum menandatangani Konvensi Pengungsi 1951 dan Protokol 1967, pemerintah Indonesia memberikan toleransi kepada lebih dari 13,000 pengungsi dan pencari suaka yang terdaftar di UNHCR Indonesia pada tahun 2021. Namun, karena perpindahan selanjutnya untuk bermukim kembali di Australia menjadi lebih sulit, masa tunggu menjadi semakin lama dan tanpa bisa dihindari, orang- orang ini telah terdampar di Indonesia. Penelitian ini menganalisis apa yang membuat para pengungsi dan pencari suaka mengalami keterlambatan di Indonesia sebelum mereka bisa masuk ke negara tujuan dan bagaimana keterlambatan tersebut berdampak pada mereka dan Indonesia. Neoliberalisme digunakan sebagai kerangka teori untuk menganalisis kasus ini dan menjawab pertanyaan penelitian. Penelitian ini menggunakan pendekatan penelitian kualitatif dan metode studi kasus untuk menggali, memahami dan menafsirkan secara mendalam permasalahan ini melalui kasus yang terjadi di Indonesia. Hasil penelitian menunjukkan bahwa faktor-faktor yang menyebabkan keterlambatan dalam perjalanan mereka berasal dari dalam dan luar Indonesia. Meskipun UNHCR Indonesia mengambil sebagian besar tugas untuk menangani masalah ini atas nama Indonesia, kantornya tidak sanggup menangani ribuan pengungsi dan pencari suaka dengan kurang dari serratus staf. Selain itu, kebijakan domestic Australia yang keras terhadap kedatangan kapal yang tidak teratur dan tidak resmi serta upayanya di regional menyebabkan penurunan penerimaan pengungsi dan dukungan finansial ke Indonesia. Akhirnya, rangkaian upaya tersebut memblokir kesempatan untuk bermukim kembali di Australia. Oleh karena itu, pengungsi dan pencari suaka terjebak di Indonesia tanpa janji apapun dan terpaksa untuk bertahan hidup sendiri. Indonesia, negara transit, menghadapi beban politik untuk menangani orang-orang yang putus asa, yang tidak pernah menjadi prioritas dalam urusan dalam negeri./Indonesia has become a transit state for refugees and asylum seekers as the last stopover en route to the intended destination state, specifically, Australia. Even though Indonesia has not signed the 1951 Refugee Convention and its 1967 Protocol, the Indonesian government has tolerated more than 13,000 refugees and asylum seekers who are registered with UNHCR Indonesia as of 2021. However, as the onward movement for resettlement in Australia has become more difficult, the waiting period has been protracted and the people have been stranded in Indonesia inevitably. This research analyzes what makes refugees and asylum seekers experience delay in Indonesia before they can get into the destination country and how such delay affects them and Indonesia. Neoliberalism is used as theoretical framework to analyze the case and to answer the research question. The research used a qualitative approach and case study method in order to deeply explore, understand, and interpret the issue from the case of Indonesia. The findings of the research suggest that the contributing factors of delay for the onward movement were from both inside and outside Indonesia. While UNHCR Indonesia takes most of the tasks for handling the issue on behalf of Indonesia, the office could not handle thousands of refugees and asylum seekers with less than a hundred staff. Also, the Australian hardline domestic policies towards irregular and unauthorized boat arrivals and its effort at the regional level induced a decrease in acceptance of refugees and financial support to Indonesia. Eventually, the series of the effort blocked the opportunity to resettle in Australia. Therefore, people get stuck in Indonesia without any promise and are forced to survive themselves. Indonesia, the transit state, faced a political burden to handle the desperate people, which had never been a priority in domestic affairs.
