Abstract

A notary is a general official authorized to make authentic deeds. This has been regulated in the provisions of Article 1 of the Act of Notary Position. The position of a Notary is also the position of a state official or public official, based on the provisions in UUJN public officials are people who carry out some public functions from the state, especially in the field of civil law. One authentic deed made by a notary is the establishment deed and amendment to the Limited Liability Company (AD). This is as stipulated in the Law of the Republic of Indonesia Number 40 of 2007 concerning Limited Liability Companies. But in reality, some notaries are often involved in matters that are contrary to the prohibitions and obligations that must be obeyed by the Notary as stipulated in the rules of the profession and the notary professional code of ethics, as well as contrary to applicable law. So that this results in the authenticity of the deed made as well as his position as a Notary who is faced with the accountability of the implementation of his position to the public. The supervision of the Notary was carried out by the Minister by establishing a Supervisory Board. The Notary Supervisory Board consists of the Regional Supervisory Board, the Regional Supervisory Assembly, and the Central Supervisory Board. So this study raises the case of the Decision of the DKI Jakarta Regional Supervisory Board Number: 03 / PTS / MPW.JKT / V / 2009 to analyze the role and violation of the Notary in making the deed. The research method was carried out in a descriptive-analytical manner. The method used in this study is a normative juridical approach. The main data in this study are secondary data. Research data in this study was conducted by means of library research and field research by conducting qualitative analysis. / Notaris merupakan pejabat umum yang berwenang membuat akta otentik. Hal ini telah diatur dalam ketentuan Pasal 1 Undang-Undang Jabatan Notaris. Jabatan Notaris juga merupakan jabatan seorang pejabat negara atau pejabat umum, berdasarkan ketentuanketentuan dalam UUJN pejabat umum adalah orang yang menjalankan sebagian fungsi publik dari negara, khususnya di bidang hukum perdata. Salah satu akta otentik yang dibuat oleh notaris adalah akta pendirian serta perubahan Anggaran Dasar (AD) Perseroan Terbatas. Hal tersebut sebagaimana diatur dalam Undang-Undang Republik Indonesia Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Namun pada kenyataannya, beberapa notaris seringkali terlibat dalam hal-hal yang bertentangan dengan laranganlarangan dan kewajiban yang harus ditaati oleh Notaris sebagaimana diatur dalam peraturan jabatan maupun kode etik profesi notaris, serta bertentangan dengan hukum yang berlaku. Sehingga hal tersebut berakibat pada keotentikan dari akta yang dibuatnya maupun kedudukannya sebagai Notaris yang dihadapkan pada pertanggung-jawaban pelaksanaan jabatannya kepada masyarakat. Pengawasan atas Notaris tersebut dilakukan oleh Menteri dengan membentuk Majelis Pengawas. Majelis Pengawas Notaris tersebut terdiri atas Majelis Pengawas Daerah, majelis Pengawas Wilayah, dan Majelis Pengawas Pusat. Maka penelitian ini mengangkat kasus kasus Putusan Majelis Pengawas Wilayah DKI Jakarta Nomor: 03/PTS/MPW.JKT/V/2009 untuk menganalisis peran dan pelanggaran Notaris dalam pembuatan akta. Metode penelitian dilakukan secara deskriptif-analitis. Metode yang digunakan di dalam penelitian ini adalah pendekatan yuridis normatif. Data pokok dalam penelitian ini adalah data sekunder. Penelitian data dalam penelitian ini dilakukan dengan cara penelitian kepustakaan dan penelitian lapangan dengan melakukan analisa kualitatif.
