Abstract

The Winner of the Auction as a buyer with good intentions often encounters obstacles in mastering the auction object that they have bought through the Mortgage Execution Auction at the State Wealth Service Office and by request of the Bank or seller, although legally the winner of auctioneer has been protected and if there is a third party who still controls the auction object they can submit a direct Execution of Discharges to the District Court without going through any lawsuit first based on article 200 of HIR. The main problem of this thesis is how to vacate the house or the auction object that is controlled by a third party by the Winner of the auction according to the decision of the Chairperson of Bekasi District Court No. 04/Eks.Lelang/2018/PN.Bks 3rd April, 2018 and how the auction winner's legal protection of unlawful actions from third parties who controls the auction object. The research is juridical-normative research that uses library data, legislation and case approach in research. The results of this research is the procedures of Discharging Execution at the Bekasi District Court No. 04/Eks.Lelang/2018/PN.Bks is not implemented according to applicable procedures by officers or bailiffs in carrying out the order on decision of the Chairperson of the Bekasi District Court and legally the auction winner has been protected by the state through the provisions in Article 200 of HIR, Grosse Minutes of Bid Auction and Reglement Vendu (Stbl. In 1908 No. 189 was changed to Stbl. 1940 No 56) The solution as the winner of the auction is ensures that the object they bought is empty to avoid the process of Execution of Discharges at the District Court that is taking quite long and requires a lot of costs and the seller of the auction object should sell the collateral or the auction object with empty condition. / Pemenang Lelang sebagai pembeli yang beritikad baik, seringkali menemui hambatan-hambatan dalam penguasaan objek lelang yang telah dibelinya melalui Lelang Eksekusi Hak Tanggungan pada Kantor Pelayanan Kekayaan Negara dan Lelang atas permohonan Bank atau penjual, meskipun secara hukum pemenang lelang telah dilindungi apabila terdapat pihak ketiga yang masih menguasai objek lelang dapat mengajukan langsung upaya eksekusi pengosongan pada Pengadilan Negeri tanpa melalui Gugatan terlebih dahulu berdasarkan Pasal 200 HIR. Pokok permasalahan dalam tesis ini adalah bagaimana pengosongan rumah atau objek lelang yang dikuasai pihak ketiga oleh pemenang lelang sesuai Penetapan Ketua Pengadilan Negeri Bekasi No. 04/Eks.Lelang/2018/PN.Bks Tanggal 3 April 2018 dan bagaimana perlindungan hukum Pemenang Lelang dari tindakan-tindakan melawan hukum dari pihak ketiga yang menguasai objek lelang. penelitian ini adalah penelitian yuridis-normatif yang menggunakan data kepustakaan, peraturan perundang-undangan dan pendekatan kasus dalam penelitian. Hasil dari penelitian adalah prosedur Eksekusi Pengosongan pada Pengadilan Negeri Bekasi No. 04/Eks.Lelang/2018/PN.Bks tidak dilaksanakan sesuai prosedur yang berlaku oleh Petugas atau Juru sita dalam melaksanakan perintah Penetapan Ketua Pengadilan Negeri Bekasi dan secara hukum pemenang lelang telah dilindungi oleh Negara melalui ketentuan-ketentuan di dalam Pasal 200 HIR, Grosse Akta Risalah Lelang dan Vendu Reglement (Stbl. Tahun 1908 Nomor 189 diubah dengan Stbl. Tahun 1940 Nomor 56). Solusinya terlebih dahulu sebagai pemenang lelang memastikan objek yang dibelinya telah dalam keadaan kosong guna menghindari proses Eksekusi Pengosongan pada Pengadilan Negeri yang cukup lama dan membutuhkan banyak biaya dan Penjual objek lelang sebaiknya melakukan penjualan jaminan atau objek lelang telah dalam keadaan kosong.
