Abstract

At this moment, foreign documents issued abroad to be used in Indonesia and vice versa must follow long procedure, which needs legalization from Ministries. This procedures are costly and time wasted. International civil law system provides mechanism to solve this problem by issuing The Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents 1961. Indonesia has not ratified this Convention, however the process has started. Author is interested to research how is the Apostille Convention provision and the notary role in foreign documents legalization. This legal research use juridic normative method and analysed the data based on legislations and interview in relations to convention ratification process also public notaries. It is concluded that to legalize according to this Convention, Indonesia must ratify this Convention, then appoint the authorized authority and in the end the legalization process will be according to this Convention. At this moment notary does not have role in foreign documents legalization process in Indonesia. However, there is potential for notary to get authority to do legalization of foreign documents once Indonesia ratify the convention because the scope of work is similar with notary authority under Article 15 of Indonesian Notary Law. / Saat ini dokumen asing yang diterbitkan di luar negeri dan ingin digunakan di Indonesia maupun sebaliknya harus melalui prosedur yang panjang, yaitu dilegalisasi beberapa kementerian. Prosedur ini membutuhkan biaya serta waktu yang panjang. Sistem hukum perdata internasional ternyata telah memiliki suatu mekanisme global untuk mengatasi permasalahan ini dengan dikeluarkannya THE HAGUE CONVENTION ABOLISHING THE REQUIREMENT OF LEGALIZATION FOR FOREIGN PUBLIC DOCUMENTS 1961. Indonesia belum meratifikasi konvensi ini, namun prosesnya telah dimulai. Penulis tertarik meneliti bagaimana pengaturan mengenai legalisasi dokumen asing menurut Apostille Convention ini serta bagaimana peranan Notaris dalam proses penyederhanaan legalisasi dokumen asing. Dalam penelitian ini, pengumpulan data dilakukan dengan metode penelitian yuridis normatif yaitu meneliti perundang-undangan dan mewawancarai langsung pihak yang berkaitan dengan proses ratifikasi Konvensi serta Notaris di Jakarta. Berdasarkan hasil penelitian, dapat disimpulkan bahwa untuk melegalisasi dokumen asing berdasarkan konvensi ini, Indonesia wajib mengaksesi konvensi ini, kemudian Indonesia harus menunjuk pihak untuk melakukan legalisasi, dengan demikian proses legalisasi dokumen asing menjadi sesuai konvensi. Saat ini Notaris tidak memiliki peranan dalam proses legalisasi dokumen asing. Akan tetapi, Notaris berpotensi untuk diberikan kewenangan menangani legalisasi dokumen asing setelah Indonesia meratifikasi Konvensi tersebut karena ruang lingkup Apostille Convention sama dengan kewenangan Notaris dalam Pasal 15 Undang-undang Jabatan Notaris.
