Abstract

Penulisan hukum ini bertujuan untuk mengetahui kepastian hukum yang dapat diperoleh dalam transaksi jual beli tanah belum terdaftar di hadapan walikota setempat dengan mengacu pada Undang-Undang Nomor 5 Tahun 1960 tentang Pokok-pokok Agraria, Peraturan Pemerintah Nomor 24 Tahun 2016 tentang Pertanahan. Perubahan Hak Panitera atas Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Panitera Hak Tanah, Peraturan Pemerintah tentang Pendaftaran Tanah, dan perlindungan hukum yang diperoleh apabila ada pihak lain yang menuntut objek jual beli secara tidak sah, yaitu tanah yang tidak terdaftar dengan mengacu pada KUH Perdata Undang-Undang dan Permen ATR / BPN Nomor 21 Tahun 2020 tentang Penanganan dan Penyelesaian Perkara Pertanahan. Penulisan hukum ini merupakan penelitian normatif yang bersifat deskriptif dan menggunakan pendekatan hukum dan pendekatan konseptual. Penelitian ini menggunakan 3 bahan hukum yang merupakan bahan hukum utama yaitu KUH Perdata, Undang-Undang Nomor 5 Tahun 1960 tentang Aturan Pokok Agraria, Peraturan Pemerintah Nomor 24 Tahun 2016 tentang Pencatatan Hak Atas Tanah perubahan Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Panitera Hak Tanah, Peraturan Pemerintah tentang Pendaftaran Tanah, bahan hukum sekunder yaitu buku teks, jurnal hukum, komentar putusan pengadilan, dan bahan non hukum. Sifat analisis penelitian ini adalah kualitatif yang mendasarkan pada justifikasinya pada teori, doktrin dan pendapat ahli hukum dan sesuai dengan rumusan perundang-undangan. Dalam tulisan ini dijelaskan bagaimana kepastian hukum yang dapat diperoleh dalam transaksi jual beli tanah di hadapan walikota setempat dan perlindungan hukum yang diperoleh ketika ada pihak lain yang mengklaim objek jual beli secara tidak sah, yaitu tanah yang tidak terdaftar./ This legal writing aims to determine the legal certainty that can be obtained in the sale and purchase transaction of unregistered land before the local mayor by referring to Law Number 5 of 1960 concerning the Basic Rules of Agraria, the Government Regulation Number 24 of 2016 concerning Land Titles Registrar amendment to Government Regulation Number 37 of 1998 concerning Land Titles Registrar, the Government Regulations concerning Land Registration, and the legal protection obtained when there is another party claiming the object of sale and purchase illegally, namely the unregistered land with reference to Civil Code of Law and Permen ATR / BPN Number 21 of 2020 concerning Handling and Settlement of Land Cases. This legal writing is a normative research that is descriptive in nature and uses the Law approach and Conceptual approach. This study uses 3 legal materials, which are the primary legal material, namely the Civil Code of Law, Law Number 5 of 1960 concerning the Basic Rules of Agraria, the Government Regulation Number 24 of 2016 concerning Land Titles Registrar amendment to Government Regulation Number 37 of 1998 concerning Land Titles Registrar, the Government Regulations concerning Land Registration, the secondary legal materials namely textbooks, legal journals, and comments on court decisions, and the non-legal material. The nature of the analysis of this research is qualitative which bases its justification on the theories, doctrines and opinions of legal experts and according to the statutory formula. In this paper, explained how legal certainty that can be obtained in the sale and purchase transaction of unregistered land before the local mayor and the legal protection obtained when there is another party claiming the object of sale and purchase illegally, namely the unregistered land.
