Abstract

Pejabat Pembuat Akta Tanah merupakan pejabat umum yang diberikan kewenangan untuk membuat akta jual beli, sehingga PPAT harus memiliki kemampuan khusus di bidang pertanahan, dikarenakan akta yang dibuat oleh PPAT sebagai alat bukti yang menerangkan telah terjadi perbuatan hukum pengalihan hak. Sehingga sebelum dilakukannya penandatanganan PPAT harus terlebih dahulu memeriksa terhadap kelengkapan dokumen tersebut. Jenis penelitian ini bersifat yuridis normatif, dengan menggunakan metode kualitatif, sedangkan untuk mengkaji permasalahan hukum digunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil dari penelitian ini ialah PPAT wajib untuk menolak membuatkan akta jual beli, jika pihak penjual tidak bisa menyerahkan asli sertipikat dan para pihak tidak menunjukkan bukti pembayaran pajak yang dibebankan kepada para pihak, dan PPAT dapat dikenakan sanksi apabila tetap membuat akta jual beli tersebut./Land Deed Officials are public officials who are given the authority to make a deed of sale and purchase, so PPAT must have special capabilities in the field of land, because the deed made by PPAT as evidence that explains there has been a legal act of rights loss. So before the signing of PPAT must first check the completeness of the document. This type of research is juridical normative, using qualitative methods, while to examine legal issues used primary legal materials, secondary legal materials and tertiary legal materials. The result of this study is that PPAT is obliged to refuse to make a deed of sale and purchase, if the seller cannot submit the original certificate and the parties do not show proof of payment of taxes charged to the parties, and PPAT may be penalized if it continues to make the deed of sale and purchase.
